I am writing to request an internal review of Department for Environment, Food and Rural Affairs's handling of my FOI request 'Mersey Rural Leader Fund payments.'.

When I asked for details of Mersey Rural Leader Fund payments I expected to receive the details of the recipients/beneficiaries of the fund payments AS WELL AS specific details of the payments themselves.

PLEASE provide details of the actual payments TWINNED WITH the recipients/beneficiaries of the fund payments AND the DATE each payment was made..

PLEASE also provide details of the source of each payment (e.g. a European Union funding source) together with the purpose of each and every payment made, twinned with each beneficiary/recipient.

We will undertake an Internal Review of RPA’s handling of your request for
information, reference RFI 3464. In accordance with the legislation we
have 40 working days in which to conduct a review.
 
The last line of your e-mail, “PLEASE also provide details of the source
of each payment (e.g. a European Union funding source) together with the
purpose of each and every payment made, twinned with each
beneficiary/recipient.” will be treated as new request as this was not
covered in your original request, reference RFI 3464. The reference for
this is 3541.
 
However, from our preliminary assessment, it is clear that we will not be
able to answer this request without further clarification. Section 16 of
FoIA requires public authorities to provide advice and assistance to
applicants where reasonable. In this instance we require you to provide
further information to enable us to identify and locate the information
requested.
 
Therefore, please describe the exact detail of information you require for
‘the purpose of each and every payment made’. For example would an
associated measure code and a glossary of what those measure codes related
to in terms of funding type (eg tourism, training etc) be the type of
information you require? ?
 
Once we have received the above clarification for RFI 3541, we will be
able to proceed with your request and advise whether we can provide the
information. Please note that the 20 working day timescale for responding
to your request will commence from the date that we receive the
clarification.

It is not clear to me that a COMPLETE list of the payments has already been provided by DEFRA in the previous list. I am aware of at least one specific payment that did not appear on the list provided.

When I asked for the details of recipients/benefactors I was NOT asking for generic groupings like"TOURISM", "RETAIL" or "HOSPITALITY".
I am requesting the names of businesses, charities, organisations or individuals that have received Mersey Rural Leader Fund payments (twinned with the exact amounts and dates of the payments).

Thank you for your e-mail dated 3 March 2015, requesting that the RPA
undertake an internal review into how your request for information number
3464 was handled. In particular, you requested that the Access to
Information section (AtI) reconsidered your request and provide such
information.
 
Your original request stated – ‘Please provide details of ALL Mersey Rural
Leader Fund payments (administered by the Rural Payments Agency, an
executive agency of the Department for Environment, Food and Rural
Affairs)’.
 
Items the Internal Review considered:
 

 1. The classification of your request as a Freedom of Information Act
request was correct. The information requested did not directly
concern elements of the environment, but did meet the criteria for the
Freedom of Information Act, in terms of facilitating accountability
and public debate.

 

 2. Were there any points within your request where there was a lack of
clarity. If so, this should have prompted AtI to come back to you
asking for clarification. AtI assessed your request, and at the end of
that process felt  they did not require anything further from you –
they knew what you were looking for – a list of payments. As has now
become clear, you required more detail.

 

 3. The adequacy of the response to the request. The RPA returned a list
of payments made, which you felt was neither correct nor sufficient
against your request. To that end, RPA’s AtI section came back asking
you to set-down exactly what you were looking to receive (RFI 3541).
Your response to this request has been taken into account in this
Internal Review.

 
The Internal Review has concluded that against your original request, AtI
did not provide a correct response. Therefore AtI has been directed to
release a list of payments with as much detail against each one, as will
be legally permitted, under both Freedom of Information Act 2000 and Data
Protection Act 1998. Please find the list attached.
 
 
Publication of beneficiary information
New European legislation (Regulation 1306/2013) requires RPA to publish
information relating to all beneficiaries (both legal and natural persons)
on a website. This will include details of payments made from the 2014
agricultural financial year onwards (from 16/10/2013).
The following information will be published in accordance with Article 111
1306/2013:

* the first name and the surname where the beneficiary is a natural
person
* the full legal name as registered where the beneficiary is a legal
person
* the full name of the association as registered or otherwise officially
recognised where the beneficiary is an association without an own
legal personality
* the municipality where the beneficiary is resident or is registered
and, where available, the postal code or the part thereof identifying
the municipality
* the amounts of payment corresponding to each measure financed by the
Funds received by each beneficiary in the financial year concerned
* the nature and the description of the measures financed by either of
the Funds and under which the payment is awarded.

Information for beneficiaries receiving €1,250 or less will be published
in an anonymised way.
 
At present RPA are collating this data and organising it, ready for
publication on the CAP Beneficiaries website. At present this website only
holds the details of legal persons – we have given a link, as it may prove
