Your request asked the Commission to confirm “if a Memorandum of
Understanding exists between yourselves and the Land and Property Services
Rating Division.”

 

The Commission can confirm that your request has been considered under the
Freedom of Information Act 2000 (FOIA). The FOIA imposes a duty on the
Commission, set out in section 1(1)(a) to confirm or deny whether we hold
the information specified in your request.

 

Having searched our records, the Commission can confirm that it does not
hold a Memorandum of Understanding with the Land and Property Services
Rating Division.

 

For information, the Commission does have the authority to share
information with Land and Property Services pursuant to the power
contained in section 24 of the Charities Act (Northern Ireland) 2008.

I have included section 24 (5) below which explains that it is not an unrestricted power. It is subject to a number of considerations, e.g. restrictions in the DPA, HRA or FOI.

5) A power to disclose information under subsection (1) or (2) is subject to any express restriction imposed by or under any other statutory provision.

(6) Where any information disclosed to the Commission under or for the purposes of any statutory provision is so disclosed subject to any express restriction on the disclosure of the information by the Commission, the Commission's power of disclosure under subsection (1) shall, in relation to the information, be exercisable subject to any such restriction.
