The BPA is not a highly regarded organisation by many motorists and seen as ineffective in regulating the private parking operators who make up the bulk of its membership; MPs in the House of Commons have also echoed these concerns.

I am writing in respect of your Freedom of Information enquiry dated 25th January. This request has been handled under the Freedom of Information Act 2000.

The information you requested is set over 5 questions. I can confirm that the council do not hold the information you requested in relation to question 1 to 3. With regard to questions 4 and 5 this information can be found on the https://www.britishparking.co.uk web site.

Membership to the British Parking Association.

1. The date you first become a member.
- We do not hold this information. This authority became a member before the current Transportation Manager joined the council in (over 13 years ago).

2. The reason for becoming the member.
- No records available. There are no minutes of meetings/emails etc. where such reasons/opinions were expressed.

3. How it benefits your residents by being a member.
- No records available.

4. Benefits received by being a member of the BPA.
- This information is reasonably accessible by a visit to the BPA website S21 – Information reasonably accessible to the applicant by other means. The information you have requested is already publically available. The council is not compelled to provide information in response to an FOI request if the information is accessible by other means as the exemption under Section 21 of the Freedom of Information Act would apply. .

5. The annual costs for being a member of the BPA.
- The BPA publishes its membership costs online along with the criteria for each membership band.

With regards to your answer to Q5 -The annual costs for being a member of the BPA - whilst the BPA do publish subscription bands this does not provide me with the precise amount paid by the authority as I do not know what band the authority falls into, or have knowledge of specific discounts off the published fee scale that the authority may have negotiated. Therefore can you please provide this information?

I acknowledge receipt of your email of 5 February 2019 expressing dissatisfaction with our response to your request for information (dated 1 February 2019). The original request was handled under the Freedom of Information Act 2000.

We will be addressing your concerns by way of an Internal Review. Please accept our apologies for the late acknowledgement of this request as it was an oversight on our part. Folkestone & Hythe District Council's approach to Internal Reviews is subject to guidance produced by the Information Commissioner's Office in line with Section 45 of the Freedom of Information Act 2000.

The Secretary of State for Constitutional Affairs’ Code of Practice on the Discharge of Public Authorities’ Functions under Part 1 of the Freedom of Information Act 2000, issued under Section 45 reads, in part, as follows:

“39. The complaints procedure should provide a fair and thorough review of handling issues and of decisions taken pursuant to the Act, including decisions taken about where the public interest lies in respect of exempt information. It should enable a fresh decision to be taken on a reconsideration of all the factors relevant to the issue…”

Consequently, the scope to be considered by a review is whether the Council’s response on 1 February 2019 breached the Act or was otherwise incorrect. In evaluating this, the case will be examined anew, taking into account the points and evidence raised during your review request. In the interest of ensuring your arguments are examined comprehensively and fairly, please can you confirm if the below understanding is correct?

Dear ‎ Mr Jonathan WIlliams,

I refer to your application dated 18 April 2019 for an internal review of
the council’s decision on your request under the Freedom of Information
Act 2000 / Environmental Information Regulations 2004.  Your request for
an internal review was as follows:

 

•           With regards to your answer to Q5 -The annual costs for being
a member of the BPA - whilst the BPA do publish subscription bands this
does not provide me with the precise amount paid by the authority as I do
not know what band the authority falls into, or have knowledge of specific
discounts off the published fee scale that the authority may have
negotiated.  Therefore can you please provide this information?.

 

In considering your request I have looked at case impartially and
reconsidered the relevant factors. In light of this, I can confirm that I
consider the original handling of the case to be partially unjustified in
that a response was delayed.  The initial response to your request
 directed you to a website where the information was held.  It was only
once you clarified your request by making the above statement, that we
delayed in responding in a timely manner.  As a result, we can now provide
the information that you have requested.

 

-            This Authority's Annual Membership renewal fee- £661 + VAT,
however, as we are VAT exempt, VAT would not be included in the payment.
