The BPA is not a highly regarded organisation by many motorists and seen as ineffective in regulating the private parking operators who make up the bulk of its membership; MPs in the House of Commons have also echoed these concerns.

Therefore, can you please provide the following information about your membership:
- The date you first become a member.
- The reason for becoming the member.
- How it benefits your residents by being a member.
- Benefits received by being a member of the BPA.
- The annual costs for being a member of the BPA.

The response to your request is:

 

  - The date you first become a member. Horsham District Council can
confirm that there are no minutes of meetings/emails confirming when it
first became a member of the BPA. It therefore does not hold this
information.

 

  - The reason for becoming the member. Horsham District Council can
confirm that there are no minutes of meetings/emails detailing the reasons
for becoming a member of the BPA. It therefore does not hold this
information.

  - How it benefits your residents by being a member. Horsham District
Council can confirm that there are no minutes of meetings/emails. It is
therefore outside of the scope of the Freedom of Information Act   2000.

 

  - Benefits received by being a member of the BPA. - Under Section 21 of
the Freedom of Information Act 2000. The BPA publishes its membership
benefits and so this information is readily available to the public
elsewhere.

 

  - The annual costs for being a member of the BPA. – Under Section 21 of
the Freedom of Information Act 2000 – The BPA publishes its membership
costs online along with the criteria for each membership band. Similarly,
LA’s have to publish their statement of accounts which will show annual
parking turnover used to calculate the membership fee.  Full accounts may
also include expenditure such as BPA membership. Therefore, as the
information is within the public domain it is not information which needs
to be released as part of this FOI.

Dear Sirs,

Thank you for your prompt response.

With regards to your answer to "Q5 - The annual costs for being a member of the BPA.", whilst the BPA does provide a banded schedule of fees and an estimate of the amount that the authority spendings on membership could be estimated from parking revenue it would still only be an estimate as it would not capture any possible discounts the authority had negotiated or additional fees not part of the standard membership.

I have also not been able to determine the fee, as the authority's own spending records > £500 show the following payment to the British Parking Association:
23/03/2018 . 4519.20 BRITISH PARKING ASSOCIATION
It does not correspond to any published membership fee for a public sector organisation.

I write to confirm that the Council has reviewed the response to your
request.

 

On 25 January 2019 you requested the following information:

 

‘Can you please provide the following information about your membership:

On 22 February 2019, the Council’s parking maintenance and contract
supervisor responded to your original request.

 

Following this, in your email dated 22 February 2019 you sought further
clarification of the response to part 5 of your request in which the
Council had stated: ‘Under Section 21 of the Freedom of Information Act
2000 – The BPA publishes its membership costs online along with the
criteria for each membership band. Similarly, LA’s have to publish their
statement of accounts which will show annual parking turnover used to
calculate the membership fee.  Full accounts may also include expenditure
such as BPA membership. Therefore, as the information is within the public
domain it is not information which needs to be released as part of this

You stated that you have ‘not been able to determine the fee, as the

The relevant department of the Council, namely Parking Services were
contacted and it appears that the figure of £4519.20 you are referring to
relates to the Council’s membership with Park Mark and not BPA.

Dear Horsham District Council,

I am writing to request an internal review of Horsham District Council's handling of my FOI request 'Membership of BPA (British Parking Association)'.

In answer to my question "The annual costs for being a member of the BPA." the authority cited S21 exemption on the basis that I could use published parking expenditure and membership fee tables to calculate the fee. I advised that I believe this assessment was incorrect as this would only be an estimate rather than a contemporaneous record and that the only sum paid to the British Parking Association in the last 12 months I could find from the authority's published data was £4519.20. The authority then confirmed that this payment was for ParkMark accreditation and not for membership - but have still failed to supply with the requested information "The annual costs for being a member of the BPA"

I have been made aware of an outstanding FOI you made regarding ‘the
annual costs for being a member of the BPA’

 

Apologies for the delay you have had in getting this information, we will
be reviewing the case to ascertain why there has been a delay and
endeavour to improve the process.

 

To answer your question, the annual fee paid by Horsham District Council
to cover membership period February 2019 – January 2020 was £897 (not
including VAT).
