I am writing to request an internal review of Newham Borough Council's handling of my FOI request 'Membership of AEHEP'.

Please review this decision, as I believe the exemption has been applied wrongly. Note that I am not requesting personal information. AEHEP membership is solely based on being Local Authority staff and is an organisation that disseminates information from Department for Education to Local Authorities. Therefore it is part and parcel of the staff member's job role whether they are members or not. It is in the public interest to be disclosed in order to demonstrate open and transparent governance.

2)    Membership of professional organisations is considered to be
personal information of the employee, which if disclosed is likely to
breach data protection principles of the officer and their personal
choices. We are not required, under section 40(2) of the Act, to provide
information that is personal to individuals as this is likely to
contravene the data protection principles. This is because the UK GDPR
requires that the processing of personal data must be fair and lawful by
the London Borough of Newham. We are of the opinion that the disclosure of
the requested information under the FOI Act is not necessary or
proportionate to meet a legitimate interest, particularly when considering
the distress that is likely to be caused to individuals with the
disclosure of their personal information via a FOI request.

Please review this decision, as I believe the exemption has been applied

I have reviewed the response sent to you previously and the reasons given
by you as to why you are dissatisfied with the response.

 

Following my review I do not believe that s40 was applied correctly to
questions 2-5 in this instance.
