Dear Department of Health,

My apologies for not thanking you before for the report, I have been ill. I am confused why some names are left in and some are redacted, could you tell me the policy on that? They are all people paid for by the public are they not ?

Yours faithfully,

Rebecca Hemsley

FreedomofInformation,

Ms Hemsley

The documents were redacted in line with S40(2) exemptions that covers the personal data of third parties where complying with the request would breach any of the principles in the Data Protection Act.

You may wish to refer to the ICO Guide to Data Protection – data protection principles: https://ico.org.uk/for-organisations/gui...

Thank you.

Dear FreedomofInformation,

Thank you i am familiar with the data protection principles and also now that there is differing interpretation of those rules. Could you therefore advise me as to why DOH has printed a specific name and not others . eg SSI inspectors page ii, what appears to be a senior official page i, officers in charge of homes - a position that most authorities release . can you assist me with the explanation that justifies the part of the data protection claimed

Yours sincerely,

Rebecca Hemsley

Dear Ms Hemsley,

Thank you for your correspondence of 6 May further to your freedom of
information request (our ref: FOI 1072278).  I have been asked to reply.

As you know, some of the names in the Department of Health’s Social
Services Inspectorate 1989 report were redacted under S40(2) of the
Freedom of Information Act.

This is because the personal details of third parties should not be
released unless these are already in the public domain, such as the name
or job title of a minister or government official that has already been
published, or if there are legal reasons why personal details should be
released.

Details of exemptions from data protection legislation are available here:

I hope this reply is helpful.

Yours sincerely,
