Please note NHS England was formed in April 2013.

NHS England may hold information relevant to your request.  However, we
are unable to process your request without further clarification.

 

Under section 1(3) of the FOI Act, an authority is not obliged to comply
with an FOI request when it reasonably requires further information in
order to identify and locate the information requested. As a result, we
would be grateful if you would clarify the following:

 

·         What capacity the meetings might have been in relation to.
Please provide as much information as possible.

 

Please note, we need clarification on capacity of meetings to help us
narrow down which department within NHS England may hold the information.
The way the request is framed currently, would exceed the cost limit as
set out in Section 12(1) of the FOI Act. Section 12(1) states that a
public authority can refuse a request if complying with it would exceed
the appropriate limit of £450 (which represents 18 hours).  This
represents the estimated cost of one person spending this time in
determining whether the information is held, and locating, retrieving and
extracting the information. We have outlined reasoning for invoking
Section 12(1) below.

 

We are a large organisation of over 5000 staff. To search for any
correspondence that may fall within the scope of your request would
require all NHS England employees to perform computer searches on a number
of computer files covering the period of your request. At a minimum of ten
minutes per search, this would exceed the limit.

 

We have estimated under section 12(1) of the FOI Act that to locate,
retrieve, extract and collate the information requested across all staff
will vastly exceed the appropriate limit set out at section 12(1) of the
Act.

 

Section 12(1) is an absolute exemption therefore we are not required to
assess the public interest test in its application.

 

As such, if you were to refine your request for information within more
specific margins, as explained above, then we may be able to continue
processing your request. Please note we cannot guarantee that Section
12(1) or any other exemptions will not apply to any information requested.

 

Please be assured we are keen to assist with your request. However, we
cannot guarantee that any exemptions under the FOI Act will not apply to
any further information requested. Please also be aware that upon receipt

Clarification:- The meetings would be to discuss funding of medication

NHS England holds recorded information in relation to this request.

 

Please note that some of this information has been withheld under section
40(2) (personal information) of the FOI Act, as the information
constitutes third party data. Section 40(2) provides that personal data
about third parties is exempt information if one of the conditions set out
in section 40(3) is satisfied. Under the FOI Act disclosure of this
information would breach the fair processing principle contained in the
Data Protection Act (DPA), where it would be unfair to that person/is
confidential. Section 40(2) is an absolute exemption and therefore not
subject to the public interest test when considering disclosure of
information. In this instance the name of all staff members at or below
Band 9 have been withheld, as have job titles in instances where the
release of that information could be reasonably used to identify
individuals who have a reasonable expectation of privacy. Information in
relation to non-NHS England staff members has also been redacted as this
constitutes third party data.
