I am writing to request an internal review of King Edward VII School, Sheffield's handling of my FOI request 'Meetings and DoI's of Governors'.

Dear KES,

Thank you posting the minutes of the meetings of the board of governors.

My reply is broadly in three sections:
- clarifications of my original request
- a Request for Review in some instances
- supplementary questions.

It is reasonable to Request a Review because whilst the minutes were provided the background material was not, i.e. the minutes as provided were incomplete without the attachments, which should also, subject to redaction if necessary, be available either on the KES website or signposted to the council website.
One example would be policy documents, another example would be reports.
Supplementary Questions are valid where the information provided, of itself, raises questions requiring clarification.

To help make this request easier to manage, I will refer to each Governor’s meeting by date.

Safeguarding
LGO said that there had been a useful meeting on the 21st November 2009, with BW in view of her role as a Safeguarding Governor. It was suggested that Governors could be invited to the Safeguarding staff training.
BJ said that it was now a statutory requirement by the Government that all staff in schools and including the Governing Body should have CRB Enhanced Disclosure clearance. Packs will be sent out shortly inviting you to sign up and there is no cost attached.

CL School Policies – Governors would like to see a full collated accessible list, with a summary of each policy’s purpose. SLT to mark them red, amber, green (amber = slight amendments needed, red = urgent). A rolling programme would be useful ie 3 yrs, 5 yrs, the policy can then be brought to the relevant committee meeting for discussion.

Investors in Diversity: BJ gave a presentation about KES’s application for this award to Governors on behalf of Linda Gooden and referred Governors to the policy documents distributed.

CL invited questions from Governors:
• suggestions were given to sharpen some wording on the policy – JJ to make the amendments and return to Linda Gooden. CL will then sign the policy to approve it and thanked LGO and BJ for their work on this.

Governor with responsibility for Attendance: CL, CF & BW have met with students to discuss attendance at Upper and Lower schools in an attempt to make young people accountable for their absence. There has been a 75% success rate on improved attendance of students who attended the panel at Upper school. CF has focussed on poor attendance at Lower school and this has included one referral to MAST. CF is awaiting further feedback on impact and is visiting Upper school on 19 April.

Updated information on NEETs from last summer: HP has received no updated information (since the previously reported number of 3 NEETs) so will chase Tony Tweedy in the LA.

LGO went through the document with Governors. LGO clarified that the school has excellent systems in place with regard to Safeguarding and explained that the local authority will conduct evaluations at certain points in terms of how effective the processes are. Discussions took place about whether school staff have training in using reasonable force. The school has no staff trained in this area and Governors decided that it was not appropriate. CL stated that behaviour in school should be monitored on an annual basis to check whether behaviour is changing. AD will send some guidance to Governors regarding reasonable force. Governors registered thanks to LGO for her work in the area of Safeguarding. LGO asked CL to complete the Governor section at the back of the Safeguarding Report and to return to JJ as soon as possible.

Behaviour: JC & CL both felt a strong sense of the school being on top of its Behaviour Management Policy. They had attended a detailed presentation which included analysis of bahviour and they were able to have a detailed discussion about the effectiveness of the isolation unit at US. The school has a robust system of capturing data. JC reported he can see improvement in behaviour around Upper School compared to years gone by, both inside the school and when students are outside of the building.

• JC asked if Helen Lane (HMI) had a direct connection to the Ofsted team? BJ said Helen Lane is a lead Ofsted Inspector assigned to the school and the team will look at what Helen is saying about the school. BJ feels that Helen will put the school into a positive light. BJ clarified that Helen Lane will not form part of the inspection team.
• CL asked as Governors, can they as a team, trigger a visit: It was clarified no, but that the visit needs to have taken place before April 2015.
• BJ said that she intends to ask Helen Lane to look at the SEF but it won’t be this term.

needed would be to consult the KES document management system for the record of which Governor had been issued with, or directed to, the policy documents.
The same principle applies to the question about policy documents being
accessible to parents, KES will have a record of what was available, to whom,
where, and when.
As for changes to policy documents, KES will hold the records of which policy
documents have changed, when, and what the changes were.
The quote of the KES record refers to the 'list'
Therefore, the list must be produced.

needed would be to consult the KES document management system for the

The same principle applies to the question about policy documents being
accessible to parents, KES will have a record of what was available, to

where, and when.
As for changes to policy documents, KES will hold the records of which
policy
documents have changed, when, and what the changes were.
The quote of the KES record refers to the 'list'
Therefore, the list must be produced.

Thank you for your cooperation with this thread of questions.
I am pleased to say that this request for information has been successfully concluded.
Based upon the information that you have sent to me it has been determined that, in my opinion:
+ there is inadequate flow of information to the board of governors
+ statements made to the board of governors cannot be supported
+ minutes indicating a failure to follow up on previously flagged items
+ there is an indication of an inappropriate relationship – overfamiliarity - between senior KES personnel and Ofsted
+ it is not understood why Ofsted appeared to consistently fail to report upon systemic management failures within KES, or why the board of governors appeared to be unaware of the failings for which they had the duty to detect and correct
+ no evidence of compliance with policy documents, and no indication from Ofsted that their audit sought evidence to demonstrate compliance ( whilst noting that over 1000 alleged agency auditors have been dismissed )
+ unexplained gaps in the issue of policy documents
+ unexplained lack of continuity
+ no evidence that the board of governors ever took the lead when allegedly supposed to be exercising oversight of KES management
+ no evidence that incidents such as bullying have been appropriately closed out in the best interests of the target of the abuse
+ no record seen of governors being informed of the costs of outsourced legal advice, whether procured via the local authority or via the private sector
+ board of governors appears to be a tick-box group that does not make the important decisions or drive the forward agenda of KES
+ whilst sufficient information relating to the requests for information has now been provided via this web site, it was unfortunate that it was necessary to make requests for review when information was denied, or, when incomplete information was provided, it was necessary to raise supplementary questions to seek clarifications
+ the KES web site, especially with respect to content inconsistency, was and remains a cause for concern
+ whilst KES has eventually provided sufficient information, it did so on several occasions after undue delay – whilst schools have extra time to reply, Section 10 remains engaged, and requests for information should be answered promptly

On the issue of the Ofsted inspectors whose services have been discontinued, it shall be for KES to determine whether such persons have ever provided their services to KES, and whether any of the areas inspected now require special attention.

The above personal observations may be taken up at your discretion, for the benefit of your students generally, and specifically for those who have need for pastoral intervention.
However, the main thrust of the observations concerns school management, its effectiveness, its independence from external intervention, and the decision-making role of the Board of Governors.
