Meeting of the Alexandra Palace and Park Board: 19th July 2018

The request was refused by Haringey Borough Council.

Dear Haringey Borough Council,

Access to Information Act 2000 (as amended)
Environmental Information Regulations

Meeting of the Alexandra Palace and Park Board: 19th July 2018

The Council is trustee of Alexandra Palace and Park charitable trust. You'll be aware that the ICO has now advised the Council about its duties as trustee under the above legislation relating to requests about the Alexandra Palace and Park, so there should be no problem about speedily co-operating with this request.

Haringey is and has been the supplier of committee services, clerking and committee administration for meetings of the above committee.

I ask to be kindly provided, under the above Act and Regulations, with a list of, and link to, or electronic copy of, all documents and reports used and referred to in compiling the reports given in the meeting above, but not published, including those in the part of the meeting in which Press and Public were excluded, as well as a full meaningful description of the issues raised and decisions taken.

I am not aware that this request repeats or duplicates any information already requested. I believe it is new information and subject to the legislation cited above, and all or part should have already been published or in the public domain and its disclosure needs to be considered on its own merits. You need not supply any information which:

1 The authority is now willing to disclose, including under its statutory duty under LGA 1972 s100 as amended (if so please advise)
2 Is already in the public domain (if so please refer to where it may be found)
3 Is exempt information under specific provisions of the above legislation

Yours faithfully,

J O'Callaghan

Haringey Borough Council

Haringey Borough Council

Dear Mr O'Callaghan,

Freedom of Information Request: Reference Lbh/8520919

I am writing in reference to your request for information received on 18
March 2019.

We are dealing with your request but needs more time to consider your
request before fully responding to you.

Section 10(3) of the Freedom of Information Act enables an authority to
extend the 20 working day limit up to a ‘reasonable’ time in any case
where;

• it requires more time to determine whether or not the balance of the
public interest lies in maintaining an exemption; or

• it needs further time to consider whether it would be in the public
interest to confirm or deny whether the information is held.

We apologise that there will be a delay in responding to your request. We
now expect to respond to you by 13 May 2019.

If you have any questions, please contact us on 020 8489 1988 or
[email address].

Yours sincerely,

Feedback and Information Governance Team

Dear Haringey Borough Council,

Thanks for your letter.
I note that you have refused to provide the information requested within the 20 working days and claimed an extension under s 10(3) FOIA 2000.

However
1. under the ICO Guidance "Any authority claiming an extension
will still be obliged to issue a refusal notice explaining which exemption applies and why, within 20 working days." You have failed to specify which exemption you claim applies;
2 You haven't stated whether the whole of the information requested is engaged, and why some of it could not now be released;
3 You haven't considered whether some of the information should be considered under the EIR rather than the FOIA. If it is environmental-related then the EIR is the correct regime;

Your response was simply a generalized template holding letter and therefore I am dissatisfied with this response and request a review of it.

Yours faithfully,

J O'Callaghan

Haringey Borough Council
