The planning application registered with Elmbridge Council is 2018/3810. I believe there have been meetings and correspondence between the Environment Agency and the developer and their representatives and consultants. Thank you for your Freedom of Information request of 14 January 2019.  We
are responding to your request for all minutes, meeting nots, and
correspondence related to planning application 2018/3810 for a development
at the Jolly Boatman/Hampton Court Station site.

Please note, these documents have been redacted in line with the Data

The Environment Agency is not able to disclose the names of those not
working within our organisation as this is personal data under the Data
Protection Act 2018 (DPA 2018) and to disclose it would breach the First
Data Protection Principle of the DPA 2018. 

 

The information requested is therefore exempt due to Regulation 13(1) of
the Environmental Information Regulations 2004, which explains that:

 

“To the extent that the information requested includes personal data of
which the applicant is not the data subject, a public authority must not
disclose the personal data if—

(a) the first condition is satisfied…”

 

The ‘first condition’ referred to above is further explained in Regulation
13(2A):

“The first condition is that the disclosure of the information to a member
of the public otherwise than under these Regulations—

(a) would contravene any of the data protection principles…”

 

The First Data Protection Principle requires that we are fair to
individuals when we collect and use their personal data.  In this case it
would be unfair to disclose information relating to an identifiable
individual as such individuals have a reasonable expectation that any
information held about them by the Environment Agency would remain
confidential.

 

If you are not satisfied with our decision not to supply the requested
information you can contact us to ask for our decision to be reviewed. If
you are still not satisfied following this, you can then make an appeal to
the Information Commissioner, who is the statutory regulator for Freedom
of Information.

Thank you for your request for information and for a review of the
Environments Agency’s handling of your request 'Meeting Minutes and
Correspondence Regarding Hampton Court Station Project' which we
originally received on 29 July 2019.

 

Your request was passed to the Thames Area Sustainable Places team leader,
in order for a review to take place of our fulfilment of your FOI request.
The original request was undertaken by a Thames Planning Advisor and the
Thames Customer and Engagement team. Subsequently, all information
available from your original request was supplied to you via email on 30
August 2019.

 

In your below email dated 30 August 2019 you have requested further
information that was outside the scope of your original request and was
not available at the time.

 

It is our conclusion that we complied fully to the original request in
line with the requirements of the FOI procedures and that we provided the
emails and correspondence relevant to your request for the period 20 March
to 29 July 2019.

 

In order to assist you with your request for a review, it is noted that
you specifically ask for meetings notes between the Environment Agency and
other parties that was scheduled for 13 August 2019. This date related to
an item that was originally outside the requested period.

 

Even if this was within the requested period, I can confirmed that we did
not hold such data at the time your request was fulfilled. However,
meeting notes relating to a meeting on 13 August were agreed on 9 October
and a copy of the published notes are attached for your reference.

 

You will notice names of individuals outside our employment have been
redacted either using XXXXXXX or redacted manually using black marker.

 

The Environment Agency is not able to disclose named individuals we have
corresponded with as this is personal data under the Data Protection Act
2018 (DPA 2018) and to disclose it would breach the First Data Protection
Principle of the DPA 2018. 

 

The information requested is therefore exempt due to Regulation 13(1) of
the Environmental Information Regulations 2004, which explains that:

can only be disclosed to the individual concerned.  This exemption applies
because the right given under the Regulations to request official
information held by public authorities does not apply to the personal data
of third parties where disclosure of that information would not be fair to
the individual, and where there is no legitimate public interest in
disclosure.

 

There is no requirement to conduct a public interest test where the
refusal relates to the exception for personal data.
