Medicine Optimisation contact information for GP practices in your CCG

Dear NHS Doncaster Clinical Commissioning Group,

We would like to be sent a file containing the contact information the Medicines Optimisation Team have for the GP Practices in your CCG. Please supply email contact details, and / or fax numbers, for each practice. Ideally the file you send should include data, for each practice, for one or more of the following headings: GP Practice Code, GP Practice Name, GP Practice Address, Telephone Number, E-mail Address and Fax Number.

These contact details are used for work purposes, and so should not be considered exempt under Section 40 of the Freedom of Information Act 2000. This information is not always listed on NHS Choices (particularly e-mail address & fax), so is not readily available in the public domain.

General Practice contact details:

 

The information which is supplied on the NHS Choices website contains the
preferred contact route for the General Practices. Please go to:

access this information. Our CCG website contains details of our Member
Practices and their publically available contact information
[2]http://www.doncasterccg.nhs.uk/about-us/...
so that you can easily align our Member Practices to their more detailed
entry on NHS Choices. The information on our CCG website includes Practice
code, Practice name, Practice address, Practice telephone number and
Practice website. We therefore consider this information to be exempt
under Section 21 of the Freedom of Information Act – information
accessible by other means.

 

General Practice Fax numbers:

 

NHS Doncaster CCG does not hold this information.

 

General Practice Email addresses:

 

NHS Doncaster CCG holds a number of email addresses for individuals
holding different roles within Member Practices. The Information
Commissioner has upheld in a number of case decisions that names and
contact details of staff are personal data for the purposes of Exemption
40(2) under the Freedom of Information Act. The question of whether the
personal data on the names and email addresses of Member Practice staff is
releasable will depend upon the status and level of the staff member. We
do not consider that it would appropriate for NHS Doncaster CCG to make an
assessment of the relative seniority of the roles of staff across the
Member Practices of the CCG. Neither is NHS Doncaster CCG in a position to
know of any particular sensitivities or safety considerations which might
attach to the provision of direct contact details for persons not employed
by us.

 

In considering the exemption for personal data, consideration must still
be given to whether the disclosure would satisfy one of the conditions for
processing listed in the Data Protection Act 1998. The conditions for
processing are set out in Schedules 2 and 3. Unless a relevant exemption
applies, at least one of the following conditions must be met whenever we
process personal data:

·        The individual who the personal data is about has consented to
the processing.

·        The processing is necessary:

o   in relation to a contract which the individual has entered into; or

o   because the individual has asked for something to be done so they can
enter into a contract.

·        The processing is necessary because of a legal obligation that
applies (except an obligation imposed by a contract).

·        The processing is necessary to protect the individual’s “vital
interests”. This condition only applies in cases of life or death, such as
where an individual’s medical history is disclosed to a hospital’s A&E
department treating them after a serious road accident.

·        The processing is necessary for administering justice, or for
exercising statutory, governmental, or other public functions.

·        The processing is in accordance with the “legitimate interests”
condition i.e. the processing is necessary for the purposes of legitimate
interests pursued by the data controller or by the third party or parties
to whom the data are disclosed, except where the processing is unwarranted
in any particular case by reason of prejudice to the rights and freedoms
or legitimate interests of the data subject.

 

We do not consider that these conditions are met in this instance as the
legitimate interests of the public are served by the provision of contact
details on the NHS Choices website as specified above.

 

Alternatively, under the Freedom of Information Act you can contact
Practices individually using the contact information on our website to
request any further information not available on NHS Choices.
