Medical or Functionability

Dear Department for Work and Pensions,

1)The DWP use the term "Functionability" to describe the Atos WCA (Work Capability Assessment), is the assessment a medical or a functionability assessment?

2)Why if a hospital consultant who has had years of training in a specific diseases or illness would the DWP overide their expert diagnosis on wheather someone is fit for work?

3)If expert diagnosis, opinion is overidden, are the DWP saying that experts in specific illnesses/diseases are not competant enough to decide if someone is fit enough to work?

4) Do the DWP believe that a RGN, a SRN, Physiotherapist,are more expert in the field of diagnosing a persons functionability than a Consultant who has many more years medical experience than those occupations stated?

5)If a claimant suffered with double incontinence and needed constant pad changes per day, ( up to 5 ), had to have them changed by a carer and was wheelchair bound, and could not leave the house without assistance from their personal carer and suffered with numerous other medical conditions including COPD, under the descriptors Atos use to ascertain someones fitness to work, what score would they get and what group would they be put in?

6) When a claimant turns up to be assessed by Atos and asks the Atos HCP to provide them with their name and qualification, does the Atos HCP have to provide the claimant with that information? and if not what happens if the Atos HCP refuses? Can the claimant refuse to be assessed by someone who refuses to give such details & what will happen to the claimants claim?

7)What is the percentage of Atos HCPs who qualified abroad?

8) The pilot study into the recording of Atos assessments finished nearly a year ago, when are the public going to be informed of when and if recording of assessments will be allowed?

9)If the decision to allow the recording of Atos assessments is ruled out by the DWP/Atos for reasons of cost etc then i suppose it would be perfectly OK for a claimant to provide his own recording devide to record said assessment for his own personal use, there is no law stipulating that is against the law/ Can you confirm or deny that?

10)Please provide me with emails between Iain Duncan Smith & Keith Wilman of Atos by private email addresses used by the minister for government business, these are covered under the FOI Act I believe?
