Dear Nottingham City Primary Care Trust (PCT),

I would like to know of the legal time frames of making a historical complaint against medical personnel for potential medical negligence. These includes a succession of Doctors , Educational Psychologists , Clinical Psychologists, Consultant Psychiatrist at Thorneywood CAHMS who all failed in their statatory duty of care.

FREEDOM OF INFORMATION ACT 2000 - INFORMATION REQUEST (248/12)

 

Your request for information under the Freedom of Information Act 2000 has
now been considered and our response is detailed below.

 

The time limit on making a complaint is 12 months from the date of the
incident giving rise to the complaint or the date that the complainant
became aware of the incident giving rise to the complaint.

 

Where a complaint is made after the 12 months time limit then the
Complaints Lead (following consultation with the Assistant Director of
Quality and Patient Safety) may use his/her discretion to accept the
complaint if the complainant had good reason for not complaining earlier
and it is possible to investigate the complaint fairly and effectively
despite the delay.

 

We must advise you that where we have provided information we have done so
subject to the provisions of the Re-use of Public Sector Information
Regulations 2005. Accordingly you must not re-use this information without
having the consent of the Trust. Where the Trust is prepared to provide
its consent then it may levy a charge for doing so. Should you wish to
re-use documents provided then you must make your request in writing
stating your name and your address for correspondence together with the
document that you wish to re-use and the purpose for which the information
is to be re-used.
