Media Appearances of Law Enforcement Agencies

I am writing to request information on media appearances by Dyfed-Powys Police (and preceding agencies) in a documentary style, such as but not limited to ‘Road Wars’, ‘Police Interceptors’, ‘Brit Cops’ etc, where a camera person(s) is deployed with police officers and are followed throughout their tour of duty.

I would like to know;
Name of production
Production Company
Policing Unit(s)/Investigation(s)/Operation(s) followed
Status of Unit (active/disbanded/reformed/reorganized)

I would also like to know the current stance on 2021 (ignoring COVID-19) for these types of shows to be filmed with Dyfed-Powys Police - are they encouraged? If encouraged, are you actively engaged in filming currently, and if so, what production? If not encouraged or banned, is there reasoning behind this, for example a negative experience/portrayal previously?

On a similar line, police forces used to sell dashcam footage as ‘filler’ in these documentary shows, between their own self shot material. Does Dyfed-Powys Police sell dashcam footage of pursuits and other incidents, or otherwise make them available?

Media Appearances of Law Enforcement Agencies

 

Dyfed-Powys Police acknowledge receipt of your request which is being
processed under the Freedom of Information Act 2000 however, prior to
processing the request please would you clarify

 

i)               Over what time period do you want the information for?
And is this in calendar or financial years?

ii)              What do you mean by ‘preceding agencies’?

 

 

After receiving the clarification, your request will then be considered and you
will receive a response within the statutory timescale of 20 working days as
defined by the Freedom of Information Act 2000, subject to the information not
being exempt or containing a reference to a third party. If we do not receive
clarification from you within 40 working days, then your request will be closed.

 

There may be a fee payable for the retrieval, collation and provision of the
information you request. If this is the case you will be informed and the 20
working day timescale will be suspended until we receive payment from you. If

Law Enforcement Agencies

 

This request is being handled under the Freedom of Information Act 2000.

 

Dyfed-Powys Police can confirm that it does hold the information covered
by your request; however we believe that we need further time in which to
provide a full response to you.

 

We consider that the following exemption of the Freedom of Information Act
may apply to the information in part:

 

Section 43(2) Commercial Interests

 

(2) Information is exempt information if its disclosure under this Act
would, or would be likely to, prejudice commercial interests of any person
(including the public authority holding it).

 

Section 43 is a class-based qualified exemption. This means that the
legislators when writing the legislation considered that the release of
such information under the Freedom of Information Act 2000 would cause
harm to the public authority or individual concerned. There is therefore
no requirement to carry out a HARM Test in respect of such information.
However there is a requirement to carry out a Public Interest Test in
order to establish whether the public interest in maintaining the
exemption may be outweighed by a wider public benefit in disclosure.

 

We now need further time in which to consider the public interest in
disclosing the information. We will endeavour to provide you with a
response as soon as possible and in any case by 19/04/2021. Should there
be any further delay we will write to you accordingly.

I write in connection with your request for information dated and received
in the Freedom of Information Unit at Dyfed-Powys Police on 18/02/21
regarding police and media programmes.

 

Your request for information has been handled under the Freedom of
Information Act 2000 and has now been considered.

 

Section 1 of the Freedom of Information Act 2000 places two duties on
public authorities. Unless exemptions apply, the first duty at Section
1(1) (a) is to confirm or deny whether the information specified in a
request is held. The second duty at Section 1(1) (b) is to disclose
information that has been confirmed as being held.

 

I can confirm that Dyfed-Powys Police does hold the information you have
requested. However we are also withholding some of that information since
we consider that the following exemption applies:

Section 43(2) – Commercial Interests

 

Where exemptions are relied upon section 17 of FOIA requires that we
provide the applicant with a notice which:

 

a) States that fact

b) Specifies the exemption(s) in question and

c) State (if that would not otherwise be apparent) why the exemption
applies

 

Please see the attached response document which details the release of
some of the information as well as the harm and public interest test
relative to the application of the exemption which in all the
circumstances of the case, the public interest in maintaining the
exemptions outweighs the public interest in disclosing the information.
