MBC Corporate Leadership Management Team -William Cornall Director of Regeneration and Place (MYERS CLARK)

Maidstone Borough Council have stated they have not used the services of Myers Clark in Watford and that their external solicitors J E Baring & Co will appoint trustees on the council's behalf.

Myers Clark Accountants and Insolvency Practitioners (Trustees MICHAEL ABRAM GOLDSTEIN and PAUL JAMES SHAW ) have been put forward as the council's preference for an nomination of IP (Insolvency Practitioner) by J E Baring & Co ( BRADLEY KEITH BLOOM and ALLAN JAMES HOOPER ) who were instructed by Mrs Sheila Coburn MBC Interim Head of Revenues & Benefits Shared Service to carry out bankruptcy work on behalf of the council who has worked with them in several different authorities.

The council have been asked to check with their Corporate Management Team Alison Broom CEO , William Cornall Director of Regeneration and Place and Mark Green Director of Finance and Business Improvement, if any of them have had any dealings with or connections to Myers Clark.

And have confirmed the following: "We do not hold information on whether members of Corporate Leadership Team have used them in any other capacity. Furthermore, the FOI Act does not apply to information held inside an officers head."

Please can you confirm under the FOI Act whether or not the following information already in the public domain is the same gentleman employed by MBC.

WILLIAM EDWARD CORNALL D.O.B. 26 January 1972, who is a chartered surveyor and company director appointed on 6 December 2012 of the following company that also uses the services of Myers Clark , Egale 1, 80 St Albans Road, Watford,Hertfordshire,WD17 1DL , for their accounts that were approved by the board of directors on 30 March 2017.

DISCIPLINARY ORDERS AND REGULATORY DECISIONS 1 February 2017

With the agreement of Myers Clark Limited of Egale 1, 80 St Albans Road, Watford, WD17 1DL, the Investigation Committee made an order that the firm be reprimanded, fined £3,250 and pay costs of £2,730 with respect to a complaint that:

1. Myers Clark Ltd prepared dormant statutory accounts for X Limited for the year ended 31 March 2015 in which the directors claimed exemption from audit, when the company’s Articles of Association required that the accounts of the company be examined and the correctness of the Income and Expenditure Account and Balance Sheet ascertained by one or more properly qualified Auditor or Auditors. 


2. Myers Clark Ltd prepared dormant statutory accounts for X Limited for the year ended 31 March 2015 which do not comply with The Small Companies and Groups (Accounts and Directors’ Report) Regulations 2008 in that the accounts do not:

a. consistently apply the accounting policies previously adopted by the company and do not disclose the reasons and effect of the change in accounting policies: 

b. show the corresponding amounts for the immediate proceeding financial year or contain any disclosures in the notes as to the reason for any adjustments: and 

c. disclose the fact that the company has acted as an agent for any person during the financial year.

Maidstone Borough Council have previously denied using the services of Myers Clark in Watford who has recently been given a disciplinary warning by the ICAEW, and that you do not hold information about members of your Corporate Leadership Team involvement with Myers Clark Limited; please provide clarification as to why you have given out false information.

Which is why you were asked to confirm if William Edward Cornall who is also a director of Stedlyn Retreat Management Limited who uses Myers Clark Limited, is also the same director of Regeneration and Place, who you state is a director of a private company set up by Maidstone Borough Council; please clarify this point.

I am writing to request an internal review of Maidstone Borough Council's handling of my FOI request 'MBC Corporate Leadership Management Team -William Cornall Director of Regeneration and Place (MYERS CLARK)'.

Maidstone Borough Council have provided confusing and conflicting information, relating to whether or not their Director of Regeneration and Place , William Cornall is also the director of a private company Stedlyn Retreat Management Limited, that also uses the services of Myers Clark Limited from whom the council nominates two joint Insolvency Practitioners to act as trustee's for people it bankrupts for non payment of council tax.

Clearly , as an officer and a member of the corporate management leadership team of the council Mr Cornall will be aware and does hold this information.

Maidstone Borough Council were asked to qualify if this information was incorrect and untrue on the 12 July 2017; it failed to do so.

On the 14 July 2017 the council were reminded that they had denied using the services of Myers Clark Limited even though they have nominated two joint Insolvency Practitioners from this firm , and further clarification was sought as to Mr Cornall's connections to Myers Clark Limited.

The council response was to ignore the substance of my request and to skip over these conflicts of interests and instead refer to a new property holding company the council has created, which is unrelated to my request.

I do not feel the Council have provided ample advice or assistance and have done everything in their power to avoid the question or their directors connections.

It is also the council who nominated the Insolvency Practitioners through their external choice of solicitors, and therefore it is false information to claim that it is the solicitors choice and not the council's . The solicitors act on behalf of the council and are the instructed by Mrs Sheila Coburn MBC Interim Head of Revenues & Benefits without a written authority or bankruptcy policy for council tax in place and no overview or scrunity by elected councillors , and who has used this solicitors firm at previous local authorities she has worked for and given them a reference on their firms website.

Limited, I can confirm that the name and date of birth quoted in your
request matches that of the current Director of Regenration and Place
employed by Maidstone Borough Council however, as previously advised, we
hold no further information regarding Stedlyn Retreat Management Limited
or Myers Clark Limited or indeed any connection between them and our
Director of Regeneration and Place.
