Dear Wirral Metropolitan Borough Council,

you must have misunderstood my request --these premises were public so there must have been public liability insurance so how much has Wirral council received --because by law you have to have this insurance --so how much did they pay out or have you not claimed yet

Wirral Council can confirm that no Council buildings were damaged in the explosion, so there is no claim for the Council to submit to our Property Insurers.

Dear Mr O'Gorman

 

We write further to your recent correspondence expressing dissatisfaction
with the Council's response to your enquiry regarding New Ferry.  I have
reviewed the correspondence exchanged to date and agree that there appears
to be a misunderstanding.  In an effort to clarify matters, I have set out
below a summary of your enquiry to date.

 

Your original question of 27 March asked:

 

"would you please tell me how much insurance money was paid to council or
other bodies for the damage done to new ferry --after the explosion or how
much is expected"

 

We responded on 28 March with " Wirral Council can confirm that The
Insurance Fund has not made any payments following the 'New Ferry Blast'
and we have not received any claims."

 

You replied with "...you must have misunderstood my request --these
premises were public so there must have been public liability insurance so
how much has Wirral council received --because by law you have to have
this insurance --so how much did they pay out or have you not claimed yet"

 

On 29 March 2019, we confirmed that no Council buildings were damaged in
the explosion so there was no claim to submit to our property insurers.

 

Your request for internal review was received 2 April stating the
following -

 

"the council says no insurance was paid out to them but as landlords, they
are supposed to have properties insured"

 

In response, we can only reiterate that Wirral Council did not own any of
the properties affected by the blast.  As such we are not landlords in
respect of any of the properties. 

 

Buildings are insured by the building owners.  The Council does not own
any of the buildings and therefore has made no insurance claims nor
received any insurance pay outs.  Wirral Council transferred all housing
stock to Magenta Living and Beechwood & Ballantyne Community Housing
Association in February 2005 and has no tenanted properties within the
affected area or at all. 

 

We hope this now clears up any misunderstanding and makes the Council's
position clear. You are entitled to complain to the Information
Commissioner's Office if you so wish and they can be contacted at

Whilst Wirral Council may have had no buildings, they do have public property that was damaged and other costs associated with this incident. Why on earth wouldn't they make a claim against the insurance?

also there was a note saying other public buildings were damaged -it is council property so there was insurance
