I should like to request the following information:

1) With respect to the Agency’s terms and conditions of employment, the current policy in relation to public and privilege holidays that fall during a period of maternity, paternity or adoption leave

2) Any prior policy pertaining to public and privilege holidays that fall during a period of maternity, paternity or adoption leave

3) The date the previous policy was amended to the current policy

4) Any internal correspondence and documents relating to an amendment to this policy - in particular any correspondence providing an explanation for changing policy (e.g. Bulletin 42, issued by the Cabinet Office in September 2011 http://bit.ly/163hSMt )

It would be helpful if you were to provide any brief notes which might be necessary to understand the context of the information provided, although I recognise that you are not obliged to do this.

under the terms of the Freedom of Information Act 2000. Please see below
the list of questions you have asked and our answers to them.

 

You Asked:

1.      With respect to the Agency’s terms and conditions of employment,

Our Reply:

Please note that the National Measurement Office (NMO) is an Executive
Agency of the Department for Business, Innovation and Skills (BIS).  NMO’s
HR policies concerning maternity, paternity and adoption leave are fully
aligned to those at BIS.

 

1.      The Agency’s current policy in relation to public and privilege
holidays that fall during a period of maternity leave states:

 

1.13 Annual leave
Employees retain their contractual entitlement to annual leave, as well as
public and privilege holidays, throughout the 52 week maternity leave
period. For part-time employees, or employees who do not take the full 52
week maternity leave period, annual leave and public and privilege
holidays will accrue on a pro rata basis.

 

The Agency’s current policy in relation to public and privilege holidays
that fall during a period of paternity leave states:

 

1.7 Terms and conditions during ordinary paternity leave

The employee’s contractual rights and benefits are maintained during the
ordinary paternity leave period. This means that the contract of
employment continues throughout unless either the employee or the
Department ends it or it expires.

 

The Agency’s current policy in relation to public and privilege holidays
that fall during a period of adoption leave states:

 

1.9 Annual leave

Employees retain their contractual entitlement to annual leave, as well as
public and privilege holidays, throughout the 52 week adoption leave
period. For part-time employees, or employees who do not take the full 52
week adoption leave period, annual leave and public and privilege holidays
will accrue on a pro rata basis.

 

2.       The previous Agency policy in relation to public and privilege
holidays that fall during a period of maternity leave states:

 

2.9     What happens with Bank Holidays/Privilege Days?

2.9.1   As you are not at work, you are not entitled to claim days off in
lieu for any bank holidays or privilege days that fall during your
maternity leave, except Maundy Thursday.  As this privilege half-day is
‘non-fixed’ and can be taken at a time mutually agreed between you and
your manager, you are entitled to claim it in lieu on your return.

2.9.2   This also applies to part-time members of staff.  As any public
and privilege holidays (other than Maundy Thursday) will be lost, you will
not need to use your Public & Privilege Holiday allowance while you are
away.  It will be prorated on your return for the remainder of your leave
year to cover any public or privilege holidays that may fall in this
period.

 

3.      The date the policy was amended is not known.

 

4.      After a search of our Electronic Documents and Records Management
System, we could find no internal correspondence relating to the change in
policy.

 

If you are unhappy with the service you have received in relation to your
request and wish to make a complaint or request a review of our decision,
you should write to me so that a review procedure can be put in place.

 

If you are not content with the outcome of your complaint, you may apply
to the Information Commissioner for a decision. Generally the ICO cannot
make a decision unless you have exhausted the complaints procedure
provided by NMO. The Information Commissioner can be contacted at: The
