Maternity laws on tier 2 visa

Response to this request is long overdue. By law, under all circumstances, Home Office should have responded by now (details). You can complain by requesting an internal review.

Dear Home Office,

Dear Sir / Madam,

Good Day,

My name is Dr. Saweera Sabbar working as a Clinical Specialist in a University Hospital (A&E division), I have recently moved into the UK (on 30/09/2015) on Tier 2 General (more than 3 years) - shortage occupation visa.

I am now pregnant and my baby is due on 1st of July 2016 and I am starting to do an extra 20 hours work per week as the tier 2 visa rules allow me to do because I fall under the shortage occupation list, I would like to inquire with regards to the Tier 2 rules.

I am planning to take my maternity leave from June 2016 and I need to know if I can continue my 20 hours of work ( locum ) during my maternity leave. My current hours would not allow me to take care of my new born baby, as it is a shift and rolling rota in which I do long hours and unsocial hours ,I would need to know if during my 52 weeks maternity leave I can still do Locum work without returning to my main job, as unfortunately I am not eligible for Occupational Maternity Pay nor Statutory Maternity Pay and in turn this will cause a huge financial constraint on me.

Doing the extra 20 hours is a flexible job in which the hours are chosen by the doctor and I could manage to hire a nanny or register my baby with a day care during these normal work hours.

I have tried to look through the UKBA website and have called a few immigration office numbers but was unsuccessful to get a clear answer regarding my situation. Since i do not intend to go against the rules I would appreciate if you could guide me in this regards.

Awaiting for a positive response.

Sincerely,
Dr. Sabbar
