Dear Mr Chapman,

Thank you for your request for information. Your request was received and logged by the FOI Team on the morning of the 12th November, the 20 working day deadline is today for a response.

Please find enclosed documents relating to your request. Please note, the Council has a right to apply an exemption if it believes one exists. In this particular case we believe the exemption Section 43 - Commercial Interests applies to meeting notes. This exemption is subject to the public interest test. In this particular case, it is considered that the public interest in releasing the information does not outweigh the public interest in withholding the information. The matter is still being discussed and no decision has been taken. The matter therefore remains commercially sensitive and the notes of the meetings will therefore not be released at this stage.

If for whatever reason you are unhappy with our response you are entitled to pursue any dissatisfaction, in the first instance, by contacting Tom Clark, Solicitor to the Council, Mid Sussex District Council, Oaklands, Oaklands Road, Haywards Heath, West Sussex, RH16 1SS, email: [email address], quoting your FOI Reference Number.

If you still remain dissatisfied with the response you can complain to the Information Commissioner - details available at: https://www.ico.gov.uk/Global/contact_us...

Information provided under the FOI Act 2000 or the Environmental Information Regulations 2004 may be not be re-used, except for personal study and non-commercial research or for news reporting and reviews, without the permission of the Council. Dear Freedom of Information,

I would suggest that in future, you do not send out automated messages when you receive a Freedom of Information request. It allows you to be late with your response and can use an excuse of 'We only saw it on Day X' For full transparency, a human should send a reply confirming when the FOI was received and viewed.

As for your response, I fail to see why you have used 'Commercial Sensitivity' as a reason not to reveal what is happening with the Martlets Hall. It is a publically owned building on public land.

A MSDC Councillor revealed to Burgess Hill Town Council in the Summer that the retail developer has been offered the hall for development. Subsequently, NewRiver Retail's public exhibition in October showed no replacement hall in their plans, and when asked, the gentleman said that MSDC have made no instruction for NewRiver Retail to provide a replacement entertainments venue anywhere in the town.

Therefore, what is possibly commercially sensitive about asking about the future of our public asset of which the council have taken out of the redevelopment equation with NewRiver Retail?

As for it not being in the public interest to release the information, you will find that there is significant public interest across the whole town with regards to the future of the Martlets Hall. Do we need to take a survey to convince you?

I did not wait 20 days just to be fobbed off, you could have done that in just a few.

Yours sincerely,

Mr Peter Chapman
