1) Please confirm that Mr. Martin Morton was paid compensation when he left the employment of Copeland Borough Council.

2) On what basis was that compensation sum paid?

3) Please provide details of the procurement process used to appoint Mr. Steve Greenway to undertake work at the Market Hall in Whitehaven.

4) Please confirm the position to which Mr. Steve Greenway was appointed to in relation to the Market Hall.

5) Please advise of any relationship you are aware of that Mr. Steve Greenway may have with any current employee of Copeland Borough Council.

6) Does any member of staff at Copeland Borough Council have any association with the company that provided the furniture for the Market Hall?

7) Does any member of Copeland Borough Council at Director level subject to whole time service conditions such that they cannot have any other employment e.g. Director of a Company, with the approval of Copeland Borough Council?

The terms and conditions for employees in Local Government includes "Employees should devote their whole-time service to the work of their Council and shall not engage in any other business or take up any other additional appointment without the express consent of the Council."

Mrs Rooney was an employee of CBC since 2015 and started the above company after she became an employee in what is a Chief Officer Role with CBC. Having been put on some £90,000+ salary did she really have time to run a couple of companies and do her day job?

Dear Mr Young,

 

Thank you for your request for information regarding Martin Morton and
Steve Greenway. Please accept my apology for the delay in response.

 

I can advise that the information requested is as follows:

 

1) Please confirm that Mr. Martin Morton was paid compensation when he
left the employment of Copeland Borough Council.

 

I can confirm that Copeland Borough Council holds the information that you
have requested. However it is exempt from disclosure under section 40(2)
of the FOIA, because it contains personal data.

 

Personal date can only be released if do so would not contravene any of
the Data Protection principles of the DPA 1998. The first principle
states:

 

Personal data shall be processed fairly and lawfully and in particular
shall not be processed unless –

 a. At least one of the conditions in Schedule 2 is met, and
 b. In the case of sensitive personal data, at least one of the conditions
in Schedule 3 is also met

 

I believe that releasing the requested information into the public domain
would be unlawful. Individuals have a clear and strong expectation that
their personal data will be held in confidence and not disclosed to the
public under the FOIA.

 

Disclosure would therefore breach the first data protection principle as
it would be unlawful. I do not have to consider schedules 2 and 3.

 

This is an absolute exemption and does not require a public interest test.

2) On what basis was that compensation sum paid?

 

As above exempt from disclosure under section 40(2) FOIA.

3) Please provide details of the procurement process used to appoint Mr.
Steve Greenway to undertake work at the Market Hall in Whitehaven.

 

Mr Greenway was procured through an external company in line with normal
Copeland Borough Council practice and procedures.

4) Please confirm the position to which Mr. Steve Greenway was appointed
to in relation to the Market Hall.

 

Mr Greenway was appointed as Programme  Manager, Working Differently
Programme with responsibility for the Accommodation Project, and answering
to the Overall Project Manager for Market Hall work.

 

5) Please advise of any relationship you are aware of that Mr. Steve
Greenway may have with any current employee of Copeland Borough Council.

 

Copeland Borough Council were fully aware of Mr Greenways personal
circumstances at the time of his appointment and his relationship with a
Copeland Director.

6) Does any member of staff at Copeland Borough Council have any
association with the company that provided the furniture for the Market
Hall?

 

None known.

7) Does any member of Copeland Borough Council at Director level subject
to whole time service conditions such that they cannot have any other
employment e.g. Director of a Company, with the approval of Copeland
Borough Council?

 

No

8) Please provide details of any approvals given by Copeland Borough
Council for any Director to undertake private work - if any.

point could you please clarify your definition of ‘private work’.
