Dear Police Service of Northern Ireland,

I am requesting all information concerning all contact between PSNI and all other 'authorities' who the PSNI claim that they have; " ... been asked to assist some of these authoritise in reponding to the request ..."

The PSNI made above and following comments in their correspondence to the ICO. Those comments appear on page 5 para 24 of the ICO's 8th November 2011 Decision Notice (Ref: FS50387372 as follows;

"The PSNI advised that the complainant had made 'numerous' requests to other public authorities on the subject of the attempted murder. The PSNI has been asked to assist some of these authorities in responding to the requests, which had taken up a considerable staff time on the part of several senior members of staff. For example, an officer at the rank of Chief Inspector had spent time dealing with these requests, and the hourly cost for this level of employee could be calculated at £66.37."

1. Who asked the PSNI to 'assist' other authorities in responding to such requests. Please also give full details as to the reason/s for this?

2. Please supply full details of all of the authorities who the PSNI assisted relating to above.

3. The PSNI have claimed that; 'several senior members of staff' dealt with above matters, what was the reason for this. Please also explain how many senior members of staff dealt with above?

4. The PSNI also clamed that; "For example, an officer at the rank of Chief Inspector had spent time dealing with these requests, and the hourly cost for this level of employee could be calculated at £66.37." Who was this 'Chief Inspector', why was he dealing with this matter. What was the total cost for the 'Chief Inspector' who deal with this matter?

Under the FOIA and also all other rights of access please also supply me with copies of all correspondence, including written notes, telephone notes/records, emails, faxes, letters and copies of all other recorded information relating to all contact between the PSNI and all of the above authorities.

In the event where the cost of complying with the request would exceed the "appropriate level", which is fixed at £450, as stated in the Freedom of Information Regulations 2004, it is the policy of the PSNI to close the request. You will however be notified of this decision and given an opportunity to refine and resubmit the request.

If your request requires either full or partial transference to another public authority in order to answer your query, again, you will be notified.

I note your comments regards;

The information and documents I am now requesting in this request is relates to that which the PSNI was boasting about within their correspondence to the ICO concerning a complaint. The above information should therefore be freely available and at hand. Moreover, the person/s who wrote to the ICO and dealt with them will alrealy have most (if not all) of the requested information.

If it is going to be the case that the PSNI are going to claim that this request would 'exceed the appropriate costs level, then I want to place on the record now that I will be request following;

(a) A detailed breakdown of the cost/s to deal with each of my numbered requests.

(b) A detailed explanation as to why each part of my request can not be dealt with including reason/s for same.

This cannot be the case i.e. the PSNI have clearly been in telephone, email contact with Compensation Agency. That contact will of course have generated information and documents in the form of emails, telephone records/notes, other correspondence and personal written notes of such conversations. I am asking the PSNI once again to release all of the information I have requested. My request was very clear, i.e. “Under the FOIA and also all other rights of access please also supply me with copies of all correspondence, including written notes, telephone notes/records, emails, faxes, letters and copies
of all other recorded information relating to all contact between the PSNI and all of the above authorities.” The PSNI have not dealt with my request correct, can they now do so and supply me with the information I have requested.

"Further to your email of 6th June 2012, your complaint regarding the delay in dealing with the internal review is noted.

An experienced staff member who conducted FOIA Internal Reviews is no longer employed with PSNI and arrangements had to be made for an alternative suitable person to conduct these. This Internal Review was allocated to Legal Services and dealt with by one of the Legal Advisers. Unfortunately Legal Services advise they are currently dealing with an exceptional volume of work and it was necessary to give priority to Court and certain other legal commitments with the result that this Review was not completed as quickly as would have been hoped. PSNI endeavour to deal with all requests as quickly as possible with the available resources. We can only apologise for any inconvenience as a result of the delay.

In relation to your first question, the review response already states (under response to question 5) that "You have been provided with a redacted copy of an email which is the only document held by PSNI relevant to your request".
In relation to your second question, as appears from the email, this followed a telephone discussion.

That being my point, you, PSNI have not supplied me with all of the recorded information I requested which would include telephone notes and records of all telephone contact between PSNI and the ICO.

By law you are required to release all non-exempt information. Please release that recorded information without further delay. Please also attach above to my complaint and ensure it too is dealt with within the correct time limits.

I will be holding back my complaint to the ICO concerning this matter until after your legal team rubber-stamp this latest whitewash.

Why has this request, matter and also my complaint not been dealt with 8 months on? You, PSNI are again subjecting me to long delays and failing to deal with my, my requests correctly and within the law.
