I refer to my EIR request of 1st July 2020, which I closed as I sent the same request to Montrose Port Authority. They have refused and state they are exempt from EIR, therefore I am sending it back to you as the licensing authority.
"I am writing to you under Environmental Information (Scotland) Regulations 2004. Please provide the following:
1) Tonnage (metric tonnes) and volume (cubic metres) of sediment deposited within the area defined by the following co-ordinates:
56 deg 45.039' N, 002 deg 25.416'W
56 deg 45.017' N, 002 deg 24.139'W
56 deg 42.448' N, 002 deg 26.660'W
56 deg 42.446'N, 002 deg 25.269'W
2) Copy of Marine Mammal Observation (MMO) log and estimate of visibility during disposal.
3) Sediment sampling results from area dredged more recent than those taken in 2012/2013 and reported in ABPmer, R2919, December 2019.
4) Likely source of contamination identified in previous sediment samples such as ship breaking in the inter tidal zone."

I am writing to request an internal review of Marine Scotland's handling of my EIR request 'Marine Licence 07149. Information on dredging operation 12 to 15th June 2020'.

Thank you for your response.
I note your refusal on grounds that you do not PRESENTLY have the information relating to volume and tonnage deposited between specified co-ordinates.
Under Part 2 section 5 of Marine Licence 07149 you have the power to request this information from the licensee and under section 6 the licensee must report the information I seek annually. I am not clear if this means at year end 2020 or one year from the dredging operation. Whichever is the sooner please provide this information when available.

With regard to the MMO's log, Marine Licence 07149 section 8 states that the completed logs must be returned to the licensing authority. There is no time limit specified therefore these should be available within a reasonable time period after the dredging operation. One month is a reasonable period.

With regard to my request on contamination sampling, I am aware of the references you provided and was not requesting them. What I was requesting is any more recent sampling, which would have been environmentally responsible before giving the licensee permission to deposit contaminated sediment offshore a public beach.
As you have not provided this can you confirm that no sampling of contaminated sediment from berths was taken before the dredging operation on 12th June 2020.

The reply to the internal review was due on 4th August, which you did not comply with and I gave you an extension until 4th September.
