Further to our acknowledgement of 17 April 2025, I have considered your
request under the Freedom of Information Act 2000 (FOIA).

 

I confirm that we hold information within the scope of your request, which
we have published about [1]Dr Manish Natverlal SHAH (4030108) on our
online register. In particular, the [2]Record of Determinations, from the
hearing into this doctor, highlights that two complaints were made by
patients in 2013.

When we make information available it is in line with our [3]publication
and disclosure policy. Outside of this we believe it's reasonable for
doctors to expect their personal data will be treated confidentially.

 

To the extent that we hold any further information within the scope of
your request, I can neither confirm nor deny whether we hold any, as I
believe it would breach data protection legislation to do so.

 

I have given details of the exemption under the FOIA which applies below.

 

The exemption

 

Section 40(5)(b)(i) of the FOIA applies where the information, if held,
would be the personal data of a third party and where confirming whether
it’s held would breach any of the principles relating to the processing of
personal data listed at Article 5 of the GDPR.  I believe that to publicly
confirm or deny whether we hold any further information would breach the
first principle, which requires that the processing of personal data is
fair, lawful, and transparent. I believe the conditions at Article 6 of
the GDPR, which are about the lawfulness of processing are not met and
therefore giving you the information would be unlawful.

 

This is in line with ICO and Tribunal decisions. In particular, I draw
your attention to paragraphs 18-26 in this Upper Tribunal [4]decision,
which upheld a variety of lower tier and ICO decisions on the use of
40(5)(b)(i).

Dear Ms Browne

I have considered this matter again and am issuing a fresh response.

Our investigation into Dr Shah was instigated after a referral by NHS
England on 29 July 2013. However, as can be seen by the online
determination, ultimately Dr Shah was erased on the basis of his criminal
convictions at trials on 19 December 2018 and 10 December 2019.

In 2019, one patient approached the GMC directly with a complaint and they
were added as an interested party to the already existing investigation.
