Dear Parliamentary and Health Service Ombudsman,

I refer to your announcement that Mandie Campbell is to start as your new CEO on the 1st October.
With the release of the review into the appointment of Mick Martin by Dame Julie Mellor, I would be grateful if you could answer the following FOI questions for me;

How was Mandie Campbell recruited to the position of CEO of PHSO? Please provide me with written evidence of the process?

Who recruited Ms Campbell to the position of CEO? Please provide me with any correspondence or emails or notes pertaining to the appointment by this individual?

Please provide me with any correspondence, notes or emails pertaining to the employment of Ms Campbell, redacting all the necessary personal information only, by the board of the PSHO?

Could you tell me whether or not the PHSO had any dealings with Ms Campbell during any investigations of complaints submitted by individuals against the Home Office to the PHSO - or any branch of the the Home Office - during the period 2012-2014. Should a time period need to be shortened in order to facilitate my request - kindly let me know.

Could you provide me with any correspondence, emails or telephone transcripts of any communication that has passed between Ms Campbell and Dame Mellor in the last year.

Please provide me with any correspondence pertaining to the appointment of Ms Campbell between the PHSO and the PACAC.

Could you provide me with any details of conflicts of interests which Ms Campbell submitted in her application for the role of CEO of the PHSO?

We are writing in response to your email, of 30 September 2016, in which
you asked a number of questions.  We will respond to each of these in
turn.

1. How was Mandie Campbell recruited to the position of CEO of PHSO?
Please provide me with written evidence of the process?

 

Gatenby Sanderson is PHSO’s preferred supplier for the recruitment of
Board and Non-Board appointments as part of the ESPO framework and they
were instructed to assist with this recruitment.  In addition, the vacancy
was advertised in the Sunday Times, Guardian Online and on the PHSO
website.  At attachment A, please find the advertisement and, at
attachment B, the information pack for candidates.

2. Who recruited Ms Campbell to the position of CEO? Please provide me
with any correspondence or emails or notes pertaining to the appointment
by this individual?

 

The selection panel comprised the Ombudsman, Dame Julie Mellor; two
non-executive board members, Helen Whalley and Jane Martin; and an
external panel member, Sheila Drew Smith OBE. 

 

Notes and correspondence relating to the appointment (for example,
interview notes and correspondence detailing the offer of employment and
terms and conditions) cannot be disclosed to the wider world as they
contain third party personal data. As such, this information is exempt in
line with section 40(2) of the Freedom of Information Act 2000 (FOIA). 

 

Ms Campbell’s agreed salary will be published as part of PHSO’s 2016/17
annual report and resource accounts – as such, this figure is exempt in
line with section 22 FOIA.  This exemption can be applied where there is
an intention to publish the requested information in the future.

3. Please provide me with any correspondence, notes or emails pertaining
to the employment of Ms Campbell, redacting all the necessary personal
information only, by the board of the PSHO?

 

At attachment C, please find the email which was sent to the Board about
the appointment.  I have also included one attachment.  The remaining
attachments are exempt as they either contain information provided
elsewhere in this response or third party personal data which is exempt in
line with section 40(2) FOIA.  Some personal data has also been removed
from the email to the Board in line with section 40(2) FOIA.

 

At attachment D, please find responses from Board members.  Again, third
party personal data, such as personal email addresses, has been redacted
in line with section 40(2) FOIA.

4. Could you tell me whether or not the PHSO had any dealings with Ms
Campbell during any investigations of complaints submitted by individuals
against the Home Office to the PHSO - or any branch of the the Home Office
- during the period 2012-2014. Should a time period need to be shortened
in order to facilitate my request - kindly let me know.

Between the business years 2011/12 and 2014/15, PHSO received a total of
4239 complaints about the Home Office.  If we were to review each case, to
determine whether or not it contained information relevant to your
request, it would significantly exceed the cost limit set out at section
12 FOIA.  For PHSO, this is 18 hours, or £450.

5. Could you provide me with any correspondence, emails or telephone
transcripts of any communication that has passed between Ms Campbell and
Dame Mellor in the last year.

 

We do not hold any correspondence relevant to your request.  Emails which
are not saved to our documents and records management system are deleted
within 90 days as per PHSO’s retention policy.

6. Please provide me with any correspondence pertaining to the appointment
of Ms Campbell between the PHSO and the PACAC.

 

There is no correspondence relating to the appointment.  An update was
provided to the Chair of PACAC during one of their regular quarterly
meetings with the Ombudsman.

7. Could you provide me with any details of conflicts of interests which
Ms Campbell submitted in her application for the role of CEO of the PHSO?

 

Please find, at attachment E, Amanda Campbell’s ‘Annual Declaration:
Conflict of Interests’ form. In addition, Ms Campbell also made the
Ombudsman aware of a Non-Executive Director role she holds with ABTA, a
travel association. This was not included on the ‘Annual Declaration:
Conflict of Interests’ form as it is unrelated to PHSO’s work.

They must -it is a duty.

Salary

'Ms Campbell’s agreed salary will be published as part of PHSO’s 2016/17 annual report and resource accounts – as such, this figure is exempt in line with section 22 FOIA.  This exemption can be applied where there is an intention to publish the requested information in the future'.

Just because it will be published it doesn't stop the PHSO being open and transparent on executive salaries now.

The information is already on file. And cannot be changed before the Annual Report is released.

There has to be an element of damage in releasing the information -covered by the evaluation in the public interest determination- which hasn't been provided.

ICO - HARM

28. Any harm that could be said to arise from the disclosure of the requested information is only relevant if it results from the early disclosure of that information, ahead of its scheduled release date. Therefore arguments in favour of maintaining the exemption must relate to that.

::

* Section 22 is applicable when the focus of the request is still under discussion and therefore the information might change between the time of the request and publication.

*Surely the PHSO is certain what MS Campbell's salary is by now?

::

ICO : IN ALL CIRCUMSTANCES
In all the circumstances it is reasonable to withhold the information until its planned publication.

 It is a qualified exemption and therefore public authorities MUST consider whether the public interest in maintaining the exemption is greater than the public interest in disclosing the requested information

* So where is the PHSO's public interest determination necessary to apply S22?

* And what are 'all the circumstances' ?

* Just stating 'we don't want to give it to you because it's going to be published anyway' is not complying with the public interest test inherent in S22.

ICO -   publication will take place once other actions have been completed;

* No. the PHSO already knows the salary. No other 'actions' relate to data already on file.

ICO   publication will take place by reference to other related events; or

* What events would change the salary?

What about the thousands of complaints (more than any other organisation the PHSO monitor) regarding the Home Office, where she was formerly employed? Will she be investigating her former colleagues and friends? She is in charge of investigative work at the PHSO.
