2 How do you ensure the claiment can view the evidence used in the decisoin against him?
3How is the claimant able to test the evidence against him?
4How can the claimant enter evidence in support of his legal Argument?
5How can the claimant face & question the officials who evidence was used to make the
origanal decision?
6 How is the claimant able to enter into a fair & equitable legal aurgument to alter the Mandatory Reconsideration if the claiment is unable to gain equal access to the Mandatory Reconsideration Process ?
7 If a claiment denies that D.W.P. had forfilled its statutory obligations regarding the
the Mandatory Reconsideration ,What procedure do you have in place to prove the actual facts of the matter?
8 Do you believe that the the manner in which the Mandatory Reconsideration is performed gives the claiment Equity of Arms considering the total lack of openness &
seemingly ignorance of commonly accepted legal norms including but not limited to The Right To Face Your accuser, Test The Evidence & rebutt the Information that D.W.P. Used to Justify Their Original Decision

Dear DWP Strategy Freedom of Information,
Concerning Mandatory Reconsideration in your reply you explain that you for-fill your obligation to
the appellant rights by making a phone call to enable them to gain a fair access to the Reconsideration process ,
If this is so i expect you are able to provide a proper evidential proof of any such inter action with the appellant & show what legitimate methods you employed to initiate such a set of phone communication's ?
What method you used to ensure that the person you were communicating private , confidential information to was the actual person it was meant for [ how did you verify the appellants identity by phone]?
What if the appellant hasn't a phone to enable you to ensure he receives all the rights to participate in the reconsideration process that entitled to him?the ability to participate in a process that's outcome is potentially life changing?
What methods does your department take to ensure that its actions are proportionate ,legal , lawful & necessary for the good of society?
In the above situation what are your methods to ensure that the appellant has
What law, statute or guidelines allow?
You claim to decide reconsideration issues by your phoning Appellants
can this be proven by a recording procedure? Or have you secure methods to identify who ever your department phone ?
Are you able to prove your statements & Who the phone conversations from your department where with? especially as you put so much store on these phone call for-filling all your legal obligations to the appellant concerning fairness?
Does this mean according to your department it for fills all its legal civil & human rights protection & obligations to claimants who are appealing because of benefit termination via the mandatory reconsiderations process being based on a phone call to person that cant even be proved to be the appellant?
when appellants have made it clear to the department that the appellant has no access to a phone how is it that the same facts are used to prove the appellant has had access to the M.R.P. & the rights of the appellant have therfore been protected?
How can you use unidentefied phone conversations to peaple you cant prove are the appellant as any sort of evedence in your submissions?
Isnt this wrong in law & your own rules?
How can you use phone conversations as evedence when you are unable to prove who is having such conversation?,Do you believe saying go see C.A.B. is forfilling the role of Access to justice? I request any legal support for your position regarding the legal rights of appellants through the Mandatory Reconsideration Period?
What if the appellants has had no phone communication which is in contradiction to the review
stating that phone communication had happened i presume that this would be a relevant difference in fact & that the truth would be relevant to the outcome of the reconsideration what methods are
in place to ensure that the truth can be determined?

I can not help but wonder just how many of these 'phone calls' are successful? Personally I have been told by DWP they tried to phone me but failed to get through on many occasions, yet I've almost Always been available at those times?!
