merger with Strode’s College in 2017 to become The Windsor Forest Colleges
Group. All information provided in this Freedom of Information Request
therefore pertains to The Windsor Forest Colleges Group.

Exempt information
The names and job titles of our Senior Leadership Team are available from

This information is exempt from disclosure under Section 21 (Information
accessible by other means) of the Freedom of Information Act (FOIA) 2000
as it is already accessible to you, however we have not relied on this
exemption in this response. Please note that the information on our
Leadership Team page has not been updated and the Deputy CEO has recently
left The Windsor Forest Colleges Group. This will be updated in due
course.
We consider that the names of the staff requested (excluding the Senior
Leadership Team) and the email addresses of all the staff requested, to be
exempt from disclosure under Section 40(2) (personal information) of the
FOIA. Names and email addresses constitute personal data.
Section 40(2) provides that personal data is exempt information if one of
the conditions set out in section 40(3) is satisfied. In our view,
disclosure of this information would breach the data protection principles
contained in the UK General Data Protection Regulations and Data
Protection Act 2018.
In reaching this decision we have particularly considered:
• The reasonable expectations of the employees given their positions.
The Windsor Forest Colleges Group considered that none of the
individuals would have a reasonable expectation that their personal
data would be disclosed;
• The consequences of disclosure; and
• Any legitimate public interest in disclosure.
Section 40(2) is an absolute exemption and therefore not subject to the
public interest test.
However, under the duty to provide information and assistance in
accordance with section 16 of FOIA we can provide contact details for
general enquiries: [2][email address] and by telephone Monday to Friday
08.30-16.45 (08.30-16.15 on Fridays and except for Bank Holidays). In

Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of East Berkshire College's handling of my FOI request 'Management Structure and Contacts'.
Although you have, with my thanks and appreciation, shared some of the information requested, you have relied on the personal data exemption and not provided the names and business email addresses of key managers. I understand that this data is considered as personal data, but this does not create an absolute exemption. In this case, I am asking you to process the data on the basis of my legitimate interest, thus requiring an appropriate balancing test of the rights of individuals including myself. I can confirm that my interest in these names and business email addresses is to allow for communication of various business, social impact and charitable objectives, and that these interests cannot be met satisfactorily through the use of a single generic email address. As the names of individual managers within your organisation would be widely known by members of your student body and other stakeholders, I would argue that this provides a basis for establishing that there is little or no negative impact on the data subject in these cases. If you have received specific objections to data processing that would impact upon my request, please confirm that this is the case, including the number of objections and the dates on which these were recorded.
