Please may I request the following information under the Freedom of Information Act:

1. What was the total number of requests made to the Mid Essex Hospital Services NHS Trust under the Freedom of Information Act, broken down by year, from 2003 – June 2013?
2. For how many requests did the Mid Essex Hospital Services NHS Trust refuse to supply the requested information? Please can this be broken down into years (from 2003 to June 2013), and grounds for refusal, for example, would take too many hours or information is confidential.
3. For how many requests did the Mid Essex Hospital Services NHS Trust reply that it did not hold the necessary information? Please can this be broken down into years (from 2003 to June 2013).
4. On how many occasions since the Freedom of Information Act came into force was an internal review of the decision by Mid Essex Hospital Services NHS Trust requested? Did this result in a change of decision on any occasion, and if so on how many occasions was this the case?
5. On how many occasions since the Freedom of Information Act came into force was a complaint made to the Information Commissioner regarding the management of a Freedom of Information request by Mid Essex Hospital Services NHS Trust? Did this result on any occasion in the company supplying information it had previously refused, and if so on how many occasions did this occur?

1555 requests total.

It is very difficult to provide a meaningful response to this question as in almost all cases the Trust is able to provide a partial response and it will not record that the Trust did not hold all of the necessary information, therefore we are unable to supply a response to this element of the question. We would add that also in amongst these requests will be some requests that demonstrate an unrealistic expectation of what Trusts hold in terms of information. Furthermore those requests which ask for opinion as opposed to fact are routinely rejected.

Any request of this type would have to be identified in amongst the sum total which would put this outside of the realms of the FOI Act in terms of time.

4. On how many occasions since the Freedom of Information Act came into force was an internal review of the decision by Mid Essex Hospital Services NHS Trust requested? Did this result in a change of decision on any occasion, and if so on how many occasions was this the case?

Approximately 6 occasions and upon each occasion the decision was not been changed as a result of the internal review.

5. On how many occasions since the Freedom of Information Act came into force was a complaint made to the Information Commissioner regarding the management of a Freedom of Information request by Mid Essex Hospital Services NHS Trust? Did this result on any occasion in the company supplying information it had previously refused, and if so on how many occasions did this occur?

None - nil return.
