property/assets including facilities management (CAFM)? TopDesk

 

*The RVC are declining to provide you with some of the information
requested under exemption Section 43 (2) (Commercial Interests) of the
Freedom of Information Act, which states that: Information is exempt
information if its disclosure under this Act would, or would likely to,
prejudice the commercial interests of any person (including the public
authority holding it). In this case, the RVC considers that the requested
information is sensitive to RVC, and the business of the company concerned
and disclosing this information would compromise the company as well as
the RVC.  As such, releasing this information would have a significant
impact on the RVC and the company’s ability to engage competitively in
future commercial activity.

 

This exemption requires the RVC to undertake a Public Interest Test. Below
you will find the reasoning for both in favour and against disclosure.

The arguments in favour of disclosure:

• Openness and transparency regarding the RVC’s commercial contracts.
• Public interest in knowing how the RVC are spending public money and
conducts its business.

The arguments against disclosure:

• The information holds significant commercial value – this information
is not in the public domain, are unique and would be advantageous to
competitors in the marketplace.
• The release of sensitive information would likely restrict the RVC’s
future purchasing options.
• Releasing the information could cause damage to the wider marketplace,
therefore limiting choice for the RVC.
• Releasing the information would affect the RVC being able to operate
effectively and in a fair environment.

As such, the RVC has concluded that releasing this information would
likely prejudice the commercial interests of the RVC and the third-party,
therefore the RVC is satisfied that the public interest in withholding the
information is greater than the public interest in disclosure.

 

 

The RVC is satisfied that in making this response, it has complied with
the requirements of the Freedom of Information Act. If, for any reason,
you are not satisfied with this response, you should request an internal
review by writing within 40 working days of receiving this response to The
Chief Operating Officer and Secretary to the Council, Royal Veterinary
College, Hawkshead Lane, North Mymms, Hatfield, AL9 7TA ( Email:

accordingly. There is no charge for such a request. Should you still be
