I refer to your Freedom of Information request in relation to Malvin's
Road, Blyth. 

Right of Access

Section 1(1) of the Act provides any person making a request for
information to a public authority is entitled.

(a) to be informed in writing by the public authority whether it holds
information of the description specified in the request (which Section
1(6) of the Act designates as the "duty to confirm or deny"), and

(b) if that is the case, to have that information communicated to him.

The right is to obtain access to the information itself and not to the
document or record which contains it.

The Act creates a general right of access to information held by public
authorities subject to various exemptions.

Q.1 Are there any plans to renew the road surface on Malvin's Road, Cowpen
Division, Blyth?
There is an allocation in the Council's highway maintenance capital
programme for the resurfacing of Malvins Road. Unfortunately work has had
to be delayed whilst an outstanding highways adoption issue concerning sub
standard kerbing works carried out by the developer, Gleesons. We are
currently working with Gleesons to resolve this matter.

Q.2 If yes, what is the timescale for these works?
No scheduled date for the works is available at the present time.

Q.3 Did the Harworth Estate housing developers contribute any revenue
towards the cost of road repair after their recent building programme?
No,  please note that repairs to Malvins Road carriageway was not a
requirement of planning permission for the residential development
adjacent.  Any dilapidated areas of existing carriageways would normally
be repaired as part of NCC's on-going general maintenance programme of
works.  It should be noted that Gleeson Homes developed the housing units
on site and not Howarth Estates.  There are no financial contributions
toward road repairs for Malvins Road being received from Gleeson Homes.
