Dear Lancashire Constabulary,

Please can you provide me with a list of all allegations made against Lancashire Constabulary between 2013 to 2018 (present date) for 'MALICIOUS PROSECUTION'?

I would like the information based on the month/year of the allegation.

This is irrespective of any civil action being taken, so please include any non-pursued cases in the civil court and reasons if known for non-pursuance.

I would also like the following information, again, in the same format as specified above?

- Cases lost in court
- Cases Won in court
- Any relevant Part 36 rulings
- Awarded costs out of court.
- Awarded costs in court.
- Any criminal proceedings born of the civil case, including the outcome.
- Total costs awarded and itemised that comes from the public purse including legal fees.

I will advise that I made the same request to you in November 2017 and my request was ignored. I am repeating my request out of courtesy and will progress this to the ICO should it be refused again.

If it is not possible to provide the information requested due to the information exceeding the cost of compliance limits identified in Section 12, please provide advice and assistance, under your Section 16 obligations, as to how I can refine my request to be included in the scope of the Act. In any case, if you can identify ways that my request could be refined please provide further advice and assistance to indicate this.

I look forward to your response within 20 working days, as stipulated by the Act.

Further to the below may we refer you to guidance published by the Information Commissioner's Office in respect of FOI requests where the cost of compliance exceeds the appropriate limit, as is the case in respect of this request. You will note that when Section 12 of the FOIA is engaged, we are not obliged to search up to the appropriate limit and there is no obligation for us to provide any information at all in such cases. Despite this as a gesture of goodwill we have previously provided you with some information pertinent to your request in respect of criminal prosecutions resulting from allegations of malicious prosecution and consequently no further work will be undertaken in relation to this request.
