Malicious Prosecutions
Dear Lancashire Constabulary,
Please can you provide me with a list of all allegations made against Lancashire Constabulary between 2013 to 2017 (present date) for 'MALICIOUS PROSECUTION'?
I would like the information based on the month/year of the allegation
This is irrespective of any civil action being taken, so please include any non-pursued cases in the civil court and reasons if known for non-pursuance.
I would also like the following information, again, in the same format as specified above?
- Cases lost in court
- Cases Won in court
- Any relevant Part 36 rulings
- Awarded costs out of court.
- Awarded costs in court.
- Any criminal proceedings born of the civil case, including the outcome.
- Total costs awarded and itemised that comes from the public purse.
I would also like information pertaining to who must authorise a public order charge if not by CPS. What is the normal process and rank for this authorisation?
Finally, please can you explain what the minimum rank of a police officer is that can authorise a a criminal charge for a summary only offence (for example, a S4 public order offence) and provide any reasons why any summary only offence would be made by a senior officer such as the Chief Constable or an assistant to the Chief Constable.
