1. Is there legislation which prevents PHSO from changing final reports as a result of a review where it is agreed that the report findings were flawed? If so please provide specific direction to such legislation.

2. Is there legislation which requires PHSO to open a new investigation where review demonstrates a final decision is flawed? If so please provide specific direction to such legislation.

3. Is there legislation which prevents PHSO from quashing a flawed final report following a review? If so please provide specific direction to such legislation.

where review demonstrates a final decision is flawed?  If so please
provide specific direction to such legislation.

 

3.  Is there legislation which prevents PHSO from quashing a flawed final
report following a review?  If so please provide specific direction to
such legislation.

 

PHSO reports are covered by Section 10 of the Parliamentary Commissioner
Act 1967 and Section 14 of the Health Service Commissioners Act 1993. No
information is held which matches the exact scope of your queries.

If you have any queries about this response, please contact the

Dear InformationRights,

thank you for your reply. As there is no specific legislation on this matter the fact that PHSO refuses to change final reports must be one of policy and as such could be altered without reference to the courts or parliament.

And all this time the public have been told a final report can't be changed. Apparently they can.....

So I wonder, do authorities who also will not change wrong records reply on the same non legislation......
