Making an appeal to the Social Security and Child Support tribunal Video

The request was successful.

Dear Sir/Madam,

I write to make a request under s1 of Freedom of Information Act 2000 relating to the video the MoJ has posted on YouTube.com to give information about appeals to the First-tier Tribunal (Social Entitlement Chamber) "the Tribunal" currently at http://www.youtube.com/watch?v=AtXiv9OPYtA

As you will be aware, this version is not the same as one produced by the MoJ and published in 2012. This request relates to the changes made between the 2012 version and the one posted in January 2013 as well as an ancillary matter below.

I would like to request copies of the policy, correspondence relating to the decision making process, including with other departments, and or the final written decision as a result of which:

(1) During Dr Jane Raynor's introduction the following information was removed:
(i) That the Appellant has probably not had a chance to discuss the decision which is being appealed before viewing the video,
(ii) That it is better to attend an oral hearing if possible as it will help the Tribunal make the "right decision",
(iii) That "twice as many appeals are successful if you turn up at the hearing";

(2) It was decided to remove references to "Gareth" feeling low;

(3) The second reference to twice as many appeals being successful if an Appellant attends on oral hearing in the voiceover was removed;

(4) The introduction from the clerk to "Gareth" removed the question about whether he had any additional evidence;

(5) The reference to a presenting officer not attending in most cases was removed;

(6) The references to "Gareth's" main problems being due to depression after his wife died were removed;

(7) The Department for Work and Pensions is referred to as such at the start of the video, but described as the "job centre" when discussing the Decision Notice;

(8) In Dr Raynor's conclusion, her comment that she hoped the Appellant watching the video would decide to attend the hearing.

And additionally

(9) Statistics relating to the number of oral hearings at which a presenting officer attended for an appeal against a decision relating to Employment and Support Allowance at the Tribunal.

I request that an internal review takes place within the prescribed time. If I do not hear from you by 17th September 2013 either acknowledging receipt of the request, or with a substantive answer to the request or internal review, I may make a complaint to the Information Commissioner without further notice.
