In view of your reliance upon the opinion of your very own internal Administration of Justice Department (AoJ) it has been necessary to add a supplementary FOI request.see below

Preamble:

I made the following FOI Under Your Reference: 150/2011

The Request and supplementary questions:

Under the Freedom of Information Act(FOI), I would like to know if Dyfed Powys Police is fully aware, and knowledgeable of Article 38. MAGNA CARTA 1215?

Clarification:

MY REQUEST IS A GENERAL REQUEST CONCERNING POLICE PROCEDURE AND BRITISH CONSTITUTIONAL LAW.

Further Clarification:

I fully understand that not all police officers have the responsibility for submitting a case to be considered for prosecution at any level, including submitting cases for consideration to the CPS.

My request is limited to those within Dyfed Powys Police with a responsibility for policing policy;

Therefore my specific question concerning Police procedure and constitutional law under the FOI Act is.......As a matter of the prosecutions policy of Dyfed Powys Police: when considering submitting a case for prosecution, where applicable, does Dyfed Powys Police take into consideration Article 38 of the Magna Carta (1215).

This request would be confined to matter of policy rather than any individual police officer.

You subsequently replied:
The Administration of Justice Department (AoJ) has confirmed that Dyfed Powys Police does not consider Article 38 Magna Carta 1215 in day-to-day procedures; Dyfed Powys Police base their processes upon legislation which has been passed through Parliament.

Dyfed Powys Police uses the Director of Public Prosecutions guidance, which is the national guidance for all forces. Please find detailed below a hyperlink to the Crown Prosecution Service website which details the guidance used by Dyfed Powys Police:

After further due consideration I believe that your reply was intended to be deliberately evasive and not in the true spirit for which the FOI Act was intended.. The use of the term The Administration of Justice Department, together with its acronym (AoJ) could easily be construed as an attempt to give the impression that The Administration of Justice Department (AoJ) is an official government body such as the Ministry of Justice (MoJ) and not just something set up on a local level by Dyfed Powys Police.

However as Dyfed Powys Police have chosen this totally unsatisfactory method of reply which does not even come close to a reply to FOI Reference: 150/2011, I have a duty to ensure that my request is properly dealt with. Consequently I do not consider your reply to be, as you state, the final reply!

Therefore under the Freedom of Information Act 2000, and based upon your previous replies thereto, I wish to know under what authority your “very own” Administration of Justice Department (AoJ) derives its ascendancy to confirm that Dyfed Powys Police does not consider Article 38 Magna Carta 1215 in the day-to-day procedures; and to further state that Dyfed Powys Police base their processes upon legislation which has been passed through Parliament.
Notwithstanding that Magna Carta predates parliament by 50 years, and should you understand it, you will see that it is a sacred binding charter issued to the nation in perpetuity, and therefore superior to, and beyond the reach of parliament.

received by the Freedom of Information Unit on 11^th July 2011, concerning
Article 38 of Magna Carta 1215. This request will be dealt with under the
terms of the Freedom of Information Act 2000.

within the statutory timescale of 20 working days i.e. 8^th August 2011 as
defined by the Act, subject to the information not being exempt or
containing a reference to a third party. In some circumstances Dyfed-Powys
Police may be unable to achieve this deadline. If this is likely you will
be informed and given a revised time-scale at the earliest opportunity.

There may be a fee payable for the retrieval, collation and provision of the
information you request. If this is the case you will be informed and the 20
working day timescale will be suspended until we receive payment from you. If
you choose not to make a payment then your request will remain unanswered.

Some requests may also require either full or partial transference to
another public authority in order to answer your query in the fullest
possible way. Again, you will be informed if this is the case.

Should you find at any stage that you no longer require the information
requested, it would be appreciated if you could notify us that you wish to
withdraw your request.

But I am afraid that you cant get away with abusing the fundamentals of the British Constitution…No one is above the law in Britain not even those who think that because they are police they can abuse it.

This reply by Dyfed Powys Police is absolute rubbish and clearly indicative of the scale of shear evil and corruption that functions in this façade of a police force! The Magna Carta 1215 is the corner stone of the British constitution! If Dyfed Powys Police claims not to know this they should be disbanded as they do not know the law of the land.

Is it any wonder this police force was found to be INSTITUTIONALLY INCOMPETENT AND ALLOWED ITS CROOKED SENIOR OFFICERS TO WALK ANY FROM THEIR CRIMES AGAINST THE PUBLIC?

I wrote an annotation on the request you made before this one and would still like to know what came of your complaint to the ICO.

You certainly made a sterling attempt to gain answers; have you found out what you wanted to since? Maybe by contacting the CPS for example as to whether they use that Act in the Magna Carter when deciding whether to prosecute.

I and most likely a number of others would like to know "what happened next?".

Dyfed Powys Police Force is a thoroughly corrupt police force, they know it and cover it all over. I know that they "Cover Up" at all costs. Cover UP is their bye word.

I have known of these actives for many years and watched the petty criminal police offices graduate into extremely dangerous people who are prepared to cover up material facts when a child negligently dies under the the care of a doctor who just happened to be their police surgeon.

Then of course there was the swindling Chief Constable, Terry Grange. Can you imagine a Chief Constable on the take from his official Visa Card just to entertain his " bit of fluff" on the side.........but that's the standard the public are forced to accept. I say forced as there is no way out, all those institutions especially the IPPC who are there to police the police are equally as corrupt.

Dyfed Police Police is the top, the highest in the whole county of most reported police forces for corruption to the IPPC. Yet no police officers ever get to court. http://www.walesonline.co.uk/news/wales-...

Work it out for yourselves: In the Dyfed-Powys force area there were 146 allegations against officers for corruption, now with just 2,100 police officers, that gave the force a ratio of 69 complaints per 1,000 officers - the highest in Wales and England. The average rate of complaint stands in the whole of the UK stands at just 33 per 1,000 officers.

However the head of the IPPC, who are supposed to be the police watchdog, Dame Anne Owers stated: "The overriding message that comes out of this report is that corruption is not widespread, or considered to be widespread. Dame Owens went on to say, "But that where corruption exists it is corrosive of the public trust that is at the heart of policing by consent."

Of course those are the words of an establishment clone and not the words of a person whose heart is committed to serving the people justly, the country and our democracy.

Sadly the establishment is top heavy with people like Dame Owens who appear to not have a clue what democracy, honesty and justice means and how to ensure that equity, fairness and honesty for all prevails. But in Britain today they are all at it. The public has little chance for fair play and honesty from practically most of the public administrative bodies, its all dog eat dog, most have their snouts in the same trough and feed well so well that they are hardly interested in the well being and rights of Mr Joe Bloggs

The degree of corruption at all levels in the administration of the UK is appalling and equal to that of any third world tinpot dictatorship. Please to take my world for it, just look around your country today with its ever decreasing standards.

Look at how the silence of the corrupt police,(social services and others) was bought in Rotherham, while hundreds, yes hundreds, we will never know the exact amount as our illustrious authorities will never reveal them, of Innocent under aged children were groomed, some abducted for forced sex by those of Eastern origin where their culture holds little value for the safety, overall well being and virginity of their young children. Girls as you as 10 years old, yes 10 years old were groomed for sex in Rotherham and other British cities, all the while the police, social services, council chiefs, politicians and others in authority able to stop such abused turned a blind eye.

Also we have to consider the overall apathy of the General public who know exactly what goes on but flatly refuses to speak up and up. Each to his own, but I can understand why they don't! Dyfed Powys Police force I know for a fact will stop at nothing, and I mean nothing, to silence those who stand up and expose their criminal activities. Their vengeance reaches deep and far, and often those speaking out end up losing all they fought to preserve. The main problem is that the police in the UK often use their publicly funded resources in a Mafia like manner using their evil tentacles reaching far and wide into society often calling in favours from others in administrative positions, who they may hold something over their heads, to help them silence those objecting to their corrupt activities. The only difference between the the police and the old Mafia is that the old Mafia has a sense of honour!

Never take anyone's word for anything, least of all mine, just stop think and look around you and assess what you see for yourselves.

The senior police officers referred to above in the child death cover up, were Chief Supt Jeff Thomas, and his colleague Supt John Daniels, both were running the Dyfed Powys Police Force CID at the time of 11 year old Robbie Powell's negligent death. Both took earlier retirement in order to avoid internal disciplinary action and thereby escaped any possibly of criminal charges and today live in comfortable retirement on a publicly paid for pension.

This is the BRITAIN that you all accept, one in which your rights are constantly eroded by an ever increasing corrupt administration.

Complaining? well try it at your peril. Why? because those in authority are stinking in corruption. I cant think of one that is not, therefore until I am told differently I am content to state that every public body in the UK is corrupted in one way or another. Take for example the recent currency trading fraud by the Bank of England no less. The alleged sex scandals of senior top politicians Leon Brittain, Cyril Smith etc. This one will run very deep, very deep indeed when all is revealed.

But with those in authority "having something on" others the pace of corruption unfolds very fast indeed.

To me its like the last straw, the final nails in the coffin of Old Blighty when we read that even the Prime Minster has some questionable activities of possible abuses of his expenses. And Man that's bad, very bad as that is your Prime Minister and if they are corrupt where does one go next?

Once the police were having a bash in the Railway Inn, Ammanford,. Supt Pat Maloy the then head of Dyfed Powys Police CID had published a book, I believe it was called a "Copper for Two Pennies". The pub was full of police and I got mixed in with the crowd. In a conversation I told told Pat Maloy he was wrong about the two Pennies as you could buy MOST Dyfed Powys Policemen for just a fiver. He went berserk, I thought he was going to have a fit. Most laughed it off, but the next day I was told by a mate of mine, a good copper in the Dyfyd Powys Police force, that the corridors of police HQ in Carmarthen were all ringing to the sound of Maloy screaming, Get him get him I don't care what it takes but get him.

We must all fight corruption for the sake of the future generations but please do so with care, its a great big risk that you take and often for a public that could not care less as long as they have their pints and bingo!
