Magistrates' Court Register

Dear HM Courts and Tribunals Service,

Hi Sian,

Rule 66B The April 2024 Magistrates Court Rules 1981 creates the duty for a magistrates' courts 'designated officer' by any member of the public making such a request for the following information:

(5)
(a) the date of a hearing in public;
(b) in general terms, the subject of the proceedings;
(c) the court’s decision at a hearing in public;
(d) whether the case is under appeal;
(e) the identity of—
(i) the parties,
(ii) the parties’ representatives, including their addresses, and
(iii) the judge, magistrate or magistrates, or justices’ legal adviser by whom a decision at a hearing in public was made;
(g) details of any reporting or access restriction ordered by the court.

1 - Can you please provide documentary confirmation that this information is stored in the court register, and
2 - If not where and in what format this information is stored?
3 - Is the legal advisors name identified in the register?

4 - Also can you confirm each register entry has a case number, and the documentary procedure of when that case number is created?

I am writing to request an internal review of HM Courts and Tribunals Service's handling of my FOI request 'Magistrates' Court Register'.

THIS IS NOT LEGAL ADVICE BEING REUESTED!

I have requested documentary evidence of procedure in Q1 which must exist as without this there is no procedure in place.
Clarifying Q2 which relates to Q1 I again an asking for documents, and
Clarifying Q3 which relates to Q2 I again am asking for documents, and
Q4 again is asking for documents

The Magistrates Court Rules express the duty, and I am asking for the documents in HMCTS control which set out those procedures.
