Good morning

Thank you for your e-mail, I am writing to advise you that your enquiry
does not fall under the Freedom of Information regime.
It may be helpful if I explain that the Freedom of Information Act (2000)
gives individuals and organisations the right of access to all types of
recorded information held, at the time the request is received, by public
authorities such as the Ministry of Justice (MoJ). Section 84 of the Act
states that in order for a request for information to be handled as a
Freedom of Information (FOI) request, it must be for recorded information.
For example, a Freedom of Information request would be for a copy of a
policy, rather than an explanation as to why we have that policy in place.
On occasion, the Ministry of Justice receives requests that do not ask for
recorded information, but ask more general questions about, for example, a
policy, opinion or a decision. In addition to this, the Macur Review is
not subject to the Freedom of Information Act.

Dear Data Access & Compliance Unit,

Thank you for your response, and links to the sites. I was aware of these.

Are you stating that there is no recorded information as to when it is due to report or when the report is due to publish?

Please could you also give more information why the Macur Review is not subject to the FOI Acts.

Does the Justice Department not have a customer service department that the questions not answerable under FOI could automatically be passed to?

Yours sincerely,

Shona Scott

This needs to go to the Information Commissioner now for a decision notice.

Dear Ms Scott,

Thank you for your email.

As your request has not been dealt with as a Freedom of Information request then you are not entitled to an Internal Review. You request is being dealt with as normal correspondence and I will pass onto the correct team for them to forward to the right department for a response.

Dear Data Access & Compliance Unit,

You refused to deal with it correctly by FOI despiet the fact it was a legitimate FOI asking for recorded infroamtion, and then refuse to internally review it, because you refused to handele it properly in the first place. Perverse logic, Please internally reiew it as you should do so

Yours sincerely,

Shona Scott
