Our Response

We have dealt with your request under the provisions of the Environmental
Information Regulations (EIR) 2004.  This is because the information
requested concerns measures and activities affecting or likely to affect
elements of the environment or affect factors such as noise, pollution
discharges and other releases into the environment.

Information Held 

1. The latest Appraisal Summary Table (AST) for the M25 Junctions 10 to 16
Smart Motorway scheme

This is provided in Annex 1.

2. The environmental scoping report (ESR) for this scheme

This is provided in Annex 2.

The M25 Junctions 10 to 16 Scoping Report was prepared in
2018.  Subsequently, in October 2019, LA 114 was issued.  National
Highways is committed to incorporating the LA 114 requirements in the M25
Junctions 10 to16 scheme.  Therefore, please note that the Scoping Report
provided here is to be updated.

3. The Environmental Assessment Report (EAR) for this scheme

The only information we hold in this regard is a draft EAR dated January
2020. 

The data and analysis presented in this draft has not been updated or
validated. This information falls under the exception in regulation
12(4)(d) of the Environmental Information Regulations because it is
unfinished material or material in the course of completion.

This exception is subject to a Public Interest Test (PIT).  The PIT we
conducted concluded that the balance of the public interest lies in
withholding the information. This conclusion was based on the following
considerations:

It may be in the public interest to disclose this information to permit
the public to comment on information where a public authority is proposing
to spend public money on a road scheme.  However, in this case the data is
out of date or has not yet been fully assessed or written up in a report
form and therefore cannot be provided in an accessible format. 
Accordingly, we believe that this outweighs any public interest in
disclosing this information at this stage.  However, the EAR will be made
available once it has been completed

4. any other assessment made of the carbon impacts of this scheme

Further to the information already provided with this response (as
described above), this information is not held..

5. Notice of Determination (NOD) for this scheme

This information is not held. To date, the NOD has not been issued
