Low rate waste tax 2005-2009

Dear North London Waste Authority,
In July 2014 I sent a freedom of information request to the Authority. The FOI request was No 201409 and I have attached it separately for your information.
In 2008 there was a landmark case between HMRC V WRG which in summary allowed every landfill operator in the country to reclaim their low rate waste taxes back from HMRC during the period of July 2005 and September 2009.
During this period you were in a partnership with Veolia. Veolia claimed their tax back so my question is why did the Authority not receive their share of this tax rebate?
