Lord Morse’s LCR mailbox account - recorded information confirmed as held by HM Treasury

Dear HM Treasury,

This is a Freedom of Information request under the Freedom of Information Act 2000.

Written evidence submitted by HM Treasury to the the First-tier Tribunal (Information Rights) in appeal number EA/2023/0003 included the witness statement dated 25 September 2023 of Huw Stephens, Chief Information Officer and Head of Treasury Business Solutions (Deputy Director level) in HM Treasury.

Paragraph 23 of this witness statement confirmed:

"The email account assigned to Lord Morse during the LCR, “[email address]”, as well as all other LCR emails, were subject to legal hold. My IT team has looked at Lord Morse’s LCR mailbox, which continues to exist and which contains 511 items in total as of 14 September 2023, 180 of which appear to be emails (as opposed to calendar entries). During the Relevant Period, the email address was used to send 25 emails."

During the scheduled hearing for appeal number EA/2023/0003 on 7 February 2024, Mr Stephens also gave gave oral testimony to the First-tier Tribunal panel members which verbally confirmed the above statement.

Dear FOI Requests,

Thank you for your reply. It would be helpful to me if you were able to ask for any clarification you believe might be required well before the statutory limit under FOIA to avoid these unnecessary delays.

In an attempt to help aid your understanding, the reference to the written witness statement, and the oral testimony of Mr Stephens in relation to the named appeal, was deliberately and specifically detailed in my original request to inform the Information Rights Unit of the known existence of Lord Morse's LCR mailbox within HM Treasury, as previous responses from the Information Rights Unit have falsely claimed that all information relating to the review had been destroyed - which has since been confirmed to be an inaccurate, misleading and untrue statement.

The recorded information being requested is the full contents of the [email address] mailbox (Lord Morse’s LCR mailbox, described by Mr Stephens as 'the email account assigned to Lord Morse during the LCR) containing 511 items. I had made use of the wording 'in full' in my original request to ensure that this could not possibly be misinterpreted, but, for the purpose of absolute clarity following your response yesterday, I am asking HM Treasury to disclose this recorded information, confirmed by Mr Stephens as being held by HM Treasury, in full.

I am writing to request an internal review of HM Treasury's handling of my FOI request 'Lord Morse’s LCR mailbox account - recorded information confirmed as held by HM Treasury'.

On 9 May 2024, you wrote what you categorised as an 'interim response' to inform me that you required additional time to assess whether the public interest in withholding this information outweighs the public interest in disclosing it, stating that it would take you another four weeks to complete your consideration.

146 working days later, I have still received no response.
