Thank you for your email dated 4 July requesting information under the
terms of the Freedom of Information Act. I am sorry for the delay in
responding while we considered your request.
I can confirm that we do hold the information you are looking for however
we are not obldiged to supply the information you have requested as it is
subject to the following statutory exemption to the right of access to
Information
Section 38 Health and Safety.
We are applying this exemption because allowing the information contained
in the traffic circulars into the public domain could put at risk the
safety of our customers and staff. Making the information in the traffic
circulars available would give the general public access to information
about our infrastructure and the safety procedures we have in place.
This information could be used to cause disruption to our services, commit
acts of vandalism and compromise the safety of staff and customers.
The use of this exemption is subject to an assessment of the public
interest in relation to the disclosure of the information concerned. We
have carefully carefully the public interest in making these documents
available as we are keen to be as open and transparent about our processes
and procedures as possible.
The information contained in the traffic circulars explain the workings of
the railway and the procedures we have place. We understand the public's
interest in this type of information but any factors for disclosure are
heavily outweighed by the public interest in ensuring that detailed
disclosure of operational processes does not lead to a reduction in the
effectiveness of our safety processes. It is possible to very easily
build up a picture of how decisions are made and the processes we have in
place. Anyone that gains this understanding of LU processes and
procedures could use this information for malicious acts.

appeal.

Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Transport for London's handling of my FOI request 'London Underground Traffic Circulars'.
This request was rejected under section 38 - Health and Safety as releasing the information could put at risk the safety of customers and staff.
While I accept that some of the information contained in the Traffic Circulars may genuinely be considered a safety risk, I think it is unlikely that this exemption applies to all of the information. I understand that the Traffic Circulars contain information on a wide range of different topics each week and I would like to request that you consider releasing the Traffic Circulars in part, redacting as necessary any particular sections considered a security risk.
In addition if you do not release all of the Traffic Circulars I would like you to consider only releasing the older ones. While a Traffic Circular from January may have been a safety risk in January, it is likely that now, 6 months later, much of the information is no longer current and therefore no longer a risk to safety.

Thank you for your email of 17 August 2010 in which you requested an internal review of TfL's response to your FOI request for LU's Traffic Circulars.
An internal review has been conducted in accordance with the attached procedure. The review considered whether all Traffic Circulars from January 2010 should have been withheld under section 38 of the Freedom of Information Act. The review found that some of the information contained within the Traffic Circulars would not endanger the health and safety of individuals if disclosed and asked that consideration be given to providing redacted copies.
I can confirm that the business area responsible for this publication has been asked to reconsider the Traffic Circulars for disclosure in light of the review's findings. I hope that we will be in a position to provide a revised response to your FOI request within the next two weeks.
