LBN: Highlighted that when this request was discussed briefly last year they wrote to E20/LS185 sharing their key concerns of which some have yet to be resolved. These were; concourse congestion, searching on the bridges and the operations manual is still being updated, they also agreed with the SGSA that although this doesn’t form part of the Safety Certificate, egress still needs to be agreed.

The Safety Certificate only includes the island and not egress, it therefore cannot be taken into account during consultation. Should an application be submitted, then formal objections would need to be presented and will be taken into consideration during the consultation period. A full seating manifest would need to be submitted which will be assessed following the guidance contained within the Green Guide.

From a SAG point of view the egress still needs resolving but from a Safety Certificate and Licensing perspective there are remaining issues which could potentially be resolved.

We had hoped that we would be able to respond to your request within the timeframe but unfortunately we are still in the process of considering your request in light of the possible use of exemptions to part of your request. Although the Act carries a presumption in favour of disclosure, it provides exemptions which may be used to withhold information in specified circumstances. Some of these exemptions, referred to as ‘qualified exemptions’, are subject to a public interest test. This test is used to balance the public interest in disclosure against the public interest in favour of withholding the information. The Act allows us to exceed the 20 working day response target where we need to consider the public interest test fully.

The information which you have requested is being considered in light of the public interest test and we are additionally required to consult third parties relevant to the requested information. We therefore need to extend the 20 working day response period. We now aim to let you have a full response by 14th June at the latest but will endeavour to respond to you as soon as possible.
