Our response is as follows:
Please find attached a redacted copy of the contract as requested
The information you have requested in relation to the names and
identifying information of individuals including the Council officers and
London Letterbox staff involved in the agreement of the contract, as well
as London Letterbox staff named as part of the tender submitted is exempt
in accordance with Section 40(2) Of the Freedom of Information Act 2000
(‘the Act’).
The Council is not obliged, under section 40(2) of the Act, to provide
information that is the personal information of another person if
releasing it would contravene any of the provisions in the Data Protection
Act and General Data Protection Regulations 2018.
In this instance we believe that the release of this information would
contravene the first data protection principle and therefore section 40
(2) is engaged. This is an absolute exemption and we are not required to
consider the public interest test.
Section 43 Exemption Engaged
Information contained in the contract is exempt from publication under
section 43(2) the Act on the basis that it is commercially sensitive.
The information contained in the contract and attached tender documents
contains information that is commercially sensitive to the consortium of
London Boroughs involved in the procurement of the contract (Enfield,
Greenwich, Hackney, Tower Hamlets and Waltham Forest), as well as London
Letterbox. This includes specific terms in the contract relating to the
contract standard, confidentiality and announcement requirements,
information relating to elements of the performance of the contract,
liability and indemnity arrangements, insurance requirements, information
in relation to required performance, the business continuity plan
requirements, certain environmental processes and the tender documents
submitted by London Letterbox, which form part of the contract.
The arguments in favour of disclosing this information are those of
general openness and transparency, as well as the public interest in
understanding how local authorities spend taxpayers’ money.
The arguments against disclosure of this information are that releasing
specific terms negotiated between the consortium and London Letterbox
would provide information that could adversely affect the ability for
these Councils to negotiate similar terms in future, and seek best value
for money for residents. Additionally, the release of London Letterbox’s
tender documents would have a significant and adverse effect on London
Letterbox’s ability to bid for future work by providing detailed
information in relation to how their services are delivered, detailed
information about the business, including its operations and staff, and
details of their pricing/charging policy. The release of this information
would be beneficial to potential competitors, and would have an adverse
effect on London Letterbox’s ability to compete for work in future.
The council has decided that he public interest in maintaining the
exemption outweighs the public interest in disclosing the information.
