Re Freedom of Information Request - London Borough of Culture Round 2 and
Round 3 applications.
I am contacting you regarding your recent Freedom of Information request
(MGLA040324-7922) and Internal review request (MGLA040324-7912).
We believe that some of the information you have requested falls under the
exemption for Commercial interests at section 43(2) of the Act, which is
subject to a public interest test.
The Freedom of Information Act (ss.10(3) and 17(2)) allows public
authorities to extend the period for responding to requests under the Act
if the information requested is subject to exemptions and longer is needed
to consider the public interest. I am writing to inform you that it will
be necessary to extend the time limit to respond to your request and
internal review beyond 20 working days in this case. We expect to have
made a decision on this matter by 30 April 2024, though if we are able to
make a decision before then, we will contact you sooner.

I am writing to request an internal review of Greater London Authority's handling of my FOI request 'London Borough of Culture 2022 & 2023'. Please note that my request concerns information about historic London Borough of Culture bids that were awarded several years ago and whose delivery was completed last year.
I am requesting an internal review for the following reasons:
1/ I would like to draw your attention to the fact that the information provided to me towards does not, in fact, answer my request. You have provided financial information that you appear to hold in excel format in pdf format which makes it inaccessible. I would like the financial information to be provided in excel of csv format. Therefore I would appreciate it if you would review this decision.
2/ As you may be aware, ICO guidance states that when applying a Section 43 exemption, an authority "must show that because [the information] is commercially sensitive, disclosure would be, or would be likely to be, prejudicial to the commercial activities of a person (an individual, a company, the public authority itself or any other legal entity)". This response does not appear to have included such details, so I am requesting that you conduct an internal review, and, if the exemption is upheld, show how the release would be prejudicial to commercial activities, and of whom.
3/ As you may be aware, ICO guidance states that the authority is obliged to conduct a public interest test when applying a Section 43 exemption (see https://ico.org.uk/media/for-organisatio...). I am requesting an internal review of my request. If the exemption is upheld, please provide details of the public interest test and how its conclusion was arrived at.
