Locomotion No. 1

Dear Science Museum Group,

On Thurs 23/1/20 you announced your decision to remove Locomotion No. 1 from Darlington's railway museum and display it in NRM's museum at Shildon.

I would like to know when this was first discussed in your group of museums? When does it date back to? I assume this was in 2019 or else in the few years preceding?

It could have first arisen in a different frame, for example, renegotiating the terms of the loan agreement.

I would like copies of all emails, minutes, briefings, handwritten notes, memos, and reports (feasibility/safety/cost/logistics), on this subject dating between 23/1/20 and the date when it first was discussed. These should show who was involved, when, why, where, and how.

I assume it would be discussed at senior or middle management level or by stand-ins for them, which should narrow your search, but you should also be able to narrow it further to relevant managers by who has responsibility for what.

Thank you for your Freedom of Information request received 29 January 2021 in which you requested the following information:

"I would like copies of all emails, minutes, briefings, handwritten notes, memos, and reports (feasibility/safety/cost/logistics), on this subject dating between 23/1/20 and the date when it first was discussed. These should show who was involved, when, why, where, and how."

Having conducted a search of our records we can confirm that we do hold information which falls within the terms of your request. However, we require some additional time to consider the application of a qualified exemption, so that we can properly reflect the balance of public interest and refer the request to appropriate members of the Science Museum Group Executive.

By virtue of section 10(3) of the Freedom of Information Act 2000, where public authorities have to consider the balance of the public interest in relation to a request, it is permitted to take extra time to comply with the request, within reason. Due to the need to consider, in all the circumstances of the case, where the balance of the public interest lies in relation to the information that you have requested, we will not be able to respond to your request in full within 20 working days.

We wish to advise you that the following exemption applies to some of the information you have requested: s.36(2), information which would, or would be likely to, inhibit the free and frank provision of advice or exchange of views for the purposes of deliberation, or would otherwise be likely to prejudice the effective conduct of public affairs.

I am confused because if only some it applies to where is the information it does not apply to?

"If you are dissatisfied with the handling of your request, you have the right to ask for an internal review."

I am dissatisfied, what you said makes no sense, I would like a review but I do not see any legal reason to delay so yes I am dissatisfied with your reply so far, it looks like you are obstructing access.

Quoting from https://ico.org.uk/for-organisations/gui... under "How much extra time can we have to consider the public interest test?" I quote "You should release any information that is not covered by an exemption within the standard time." If you read that the Information Commissioner says 'standard time' refers to the first 20 working days not the extension which is only for a 'public interest test' on some of the information as per your letter.

Are you sure your response is valid by law?
