Under the FOI ACT could you please let me know if Locala Healthcare has any contracts with Kirklees MBC or any other council.
Please identify any the councils and if possible the contract name, value, dates placed and duration.

Further to your request of 14 February please find the below information regarding the contracts Locala Community Partnerships CIC holds with any Council:

Kirklees Council - Sexual Health Kirklees; Health Visiting and Family Nurse Partnership Kirklees; School Nursing Kirklees; and, Reanablement and Rapid Response.

Calderdale Council - School Nursing Calderdale; and, Calderdale Youth Offending Team.

Bradford Council - Sexual Health Bradford.

These are the contract names, however for specific commercial information (such as value and duration) you will need to direct your request to the individual councils in order for them, as the controller of that data, to consider the eligibility of that information for release.

Please could you let me have a response to my original message which asked for contracts with Locala HOMECARE not Locala CIC.
Please note that under the FOI ACT this information I'd due no later than the 14th March unless a valid reason for not providing it is given.
Delays due to providing the incorrect information is not acceptable under the Act.

Your original e-mail with regard to this request specified "Locala Healthcare" to which we took to mean Locala Community Partnerships CIC as this is the provider of Healthcare related services.

Locala Homecare Ltd, although a subsidiary of Locala CIC, is a separate private entity and not a public body nor subject to any contractual clause which would infer a duty to comply with the Freedom of Information Act 2000.

As the duty under the FOIA2000 only extends to 'Public Bodies' or those providers of public services which are contractually obliged to respond on behalf of those they are commissioned by, realistically, to reply to your request at all we would have needed to assume that you meant the Community Interest Company rather than the Homecare Company.

We are not able to answer this request in respect of or on behalf of Locala Homecare Ltd. Further, if we were to, we would have to omit much of the information at any rate as per the original response, as the contractual information holder would actually be the individual councils in this case.

I hope this information proves useful and helps to clarify matters in respect of your request.

If Locala Homecare has any contracts with any CCG or local authority then they will be subject to the FOI act as part of that contract as that is part of their standard contract conditions.
So can you clarify that Locala Homecare has no contract with any CCG or local authority. In particularly Kirklees MBC

This is not technically correct. It would be by virtue of the Act that the public can direct their Freedom of Information request to, say, the CCG (as the public body). The CCG could then compel the provider they have commissioned to provide them with the answers to that query, so that the CCG can revert to the Requestor.

For ease, and to maintain the 20 day time limit, requests can be sent directly to the provider and thus be answered directly by them. For clarity, this situation has now been reflected and written into many standard terms and conditions under which tenders are made and contracts granted.

Locala, by virtue of its nature and structure, operates under many different contracts. Indeed until recently when we secured the Care Closer to Home contract much of the operations of Locala were not specifically subject to Freedom of Information requests, and it was the terms incorporated into that contract that brought about the duty.

However up until then, and beyond, across the board when appropriate we would answer FOI requests whether we could be compelled to or not. This was part of our ongoing commitment to be open, honest and transparent, a value to which we continue to adhere. We will answer Freedom of Information requests when able to do so.

I can clarify a number of things as follows: Locala Homecare Ltd is a separate, private entity. Its business is the provision of homecare to that part of Huddersfield in which it operates. It provides this on a private basis to those clients who contact it and request services from it.

As a third party between you as the Requestor, and Locala Homecare ltd - which is separate from Locala CIC, has its own management structure, etc. - at this point, we are unable to answer your request. You will have to direct your request to those whom would be the data holder i.e. the Council and/or the CCG. You could direct your request to the Homecare company directly, but again the same would apply as above, as they are a private Limited company and not a Public Body they would not be obliged to answer your request.
