Local Resilience Forum - Flood prevention plans

Dear North Wales Local Resilience Forum,

Please can you answer the following EIR/FOI request:

BACKGROUND INFORMATION

Local Resilience Forums (LRF) have to manage risk, make plans, and warn the public when emergencies which includes flooding.

The key duty is Section 2(1)(d) of the CCA - the LRF must:
maintain plans for the purpose of ensuring that if an emergency occurs or is likely to occur the person or body is able to perform his or its functions so far as necessary or desirable for the purpose of—
(i) preventing the emergency,
(ii) reducing, controlling or mitigating its effects, or
(iii) taking other action in connection with it,

Furthermore LRF's are required to develop and maintain a multi-agency flood plan.

MY REQUEST

1 - Please can you confirm if you have produced a multi-agency flood plan?
2 - if the answer to question 1 is yes, please can you confirm the date it was published and the date that the plan was last updated.
3 - Please can you provide a copy of the latest multi-agency flood plan and/or any similar and relevant current flood prevention plans produced by the LRF.

The Freedom of Information Act (the Act) relates to public authorities, as set out in Section 1 and Schedule 1 of the Act.

Local Resilience Forums are not defined as public authorities and therefore are not subject to the Act.

Therefore, we are unable to respond to your request.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of North Wales Local Resilience Forum's handling of my FOI request 'Local Resilience Forum - Flood prevention plans'.

Thank you for the reply, however i do not agree with your response. the LRF is subject to FOI and should respond accordingly rather than via individual stakeholders.

Please note that other LRF's have responded to the same request and provided the information

Dear Mr Scott,

Further to your recent email request for a review of the response from the North Wales Local Resilience Forum (NWLRF) to your request for information regarding Flood Prevention Plans, the response has now been reviewed by a Principal Officer from one of the local authority members of the LRF.

Following that review, the NWLRF wishes to maintain its position that it is not a public authority as defined by Schedule 1 of the Freedom of Information Act 2000 and, therefore, is not subject to the provisions of that Act. A copy of the relevant Schedule is attached and can also be accessed online at this link - Freedom of Information Act 2000 (legislation.gov.uk).
