a)   1995 York Green Belt Local Plan minutes and decisions.

The City of York Council does not hold this information. Due to Government
reorganisation in 1996 wherein York City Council became City of York
Council, this information is held by North Yorkshire County Council

b)   Local Plan incorporating the 4^th Set of Changes (2005)

Please see attached documents as requested relating to a decision to
approve the Local Plan incorporating the 4th Set of Changes for
Development Control purposes:

·        Officer Committee Report to Executive on 5 April 2005

·        Executive Minutes for 5 April 2005

·        Council Minutes for 12 April 2005

 

There is no decision relating to the withdrawal of the Local Plan (2005);
this continues to be applied for decision-making in the city pending the
adoption of the emerging new Local Plan for the city. However, the
policies in the 2005 Local Plan were drafted prior to the [3]National
Planning Policy Framework and therefore weight afforded to these policies
can only be very limited. For further information on this plan see:

Could I just clarify with you your answer to questions 1(a) and 1(b) as I think there might have been some misunderstanding in what you think I was asking.

My question was:

Just to clarify; I am aware that a Government re-organisation took place in 1996 and my understanding is that before this occurred North Yorkshire County Council would be the body responsible for making the decisions relating to the Local Plan so for any question relating to a time before that re-organisation I should address the question to NYCC.

The period of time that I am interested in is immediately after the re-organisation up-to the present day. My reference to '1995' is due to that being the date of the post-modification plan being published('1995 York Green Belt Local Plan post-modification') . I am not asking for decisions you made in 1995. I Understand that CYC did not exist in 1995 and could therefore have made no decisions in 1995, but this was not what the question related to.

My understanding here is that York Unitary Authority would be the correct body to ask. Am I right in my belief that City of York Council are York Unitary Authority? If so the question is intended for CYC not NYCC.

I appreciate that you have told me you do not hold the information requested and that would be an acceptable answer under FOI if you were to give it. I am just not sure at this stage if you have said you don't hold the information because you have assumed my question was asking about an event in 1995 before the existence of CYC and therefore would believe that you do not hold the information because you do not hold any information from that period, or if you did check to see what information that you hold and have found that you hold no information in relation to the questions asked during the period after the Council re-organisation took place.

I would be grateful if you could clarify if your answer does include a search and failure to find any relevant documents held between the formation of York Unitary Authority in 1996 and the present day. Thank you.
