Cafcass Diversity in cases, including anti discriminatory practice 2.46:

Cafcass State: “Cafcass does not collect diversity data nationally in respect of service users because we take the view that standard diversity monitoring forms cannot capture useful information about children’s diversity needs. Instead it is the practitioners responsibility to identify any diversity issues in a specific case. In addition to this requirement, each Cafcass service and service area has a responsibility to identify the diversity needs of groups of children living in their area where we are involved and to take action accordingly. Such local diversity issues should be recorded along with action taken in local business plans”

Therefore

1a. Please supply me with information showing where the “Leeds Cafcass office: Bleinham house, Duncombe Street, Leeds LS1 4PL have recorded diversity issues and taken action in local business plans ?

1b. What action has the listed Leeds Office taken to identify what the diversity needs of groups of children are in Leeds

and

1c. Are the Leeds office in accordance with any policy or procedure & in law expected to identify the diversity needs of vulnerable adults they also work with ?

2. Please confirm if it is the practitioners responsibility in the Leeds office to identify both a child and and adult in the cases disability needs or any other diversity needs ?

3. CAFCASS diversity policies appear to be limited to the diversity needs of the child therefore can CAFCASS state where “specifically” in their policies to “diversity in cases including anti discriminatory paractice” specifically pertain to ‘disabled adults’& their legal obligations to collect ‘adult’ diversity needs ?

Dear Governance,

If you do not hold the information I request about diversity then simply state that as opposed to incorrectly stating vexatious. Calling requesters vexatious where you can not provide a requester with information about diversity is inappropriate.

There is much to be understood of what you have failed to provide and can not provide around Diversity which is why you are making incorrect attempts at deeming requests vexatious.

The questions I ask can be asked by anyone regardless of how many FOI’s I have sent and it is simply easier to speak directly with the ICO because ‘Disability’ is omitted from your anti-discriminatory practice statement.
Disability not being included in Cafcass anti discriminatory statement seeks serious purpose, which is not personal but in the public interest.

Diversity information has relevance where disability it is not included in a statement which may result in biases and discriminatory practice. It should not be ‘vexatious’ i.e annoying frustration to provide this information for any organisation but could be ‘worrying’ for an organisation to omit disability from a diversity statement.
