Dear Mr McAtominey

We acknowledge receipt of your e-mail requesting information from the Trust under the provisions of the Freedom of Information Act 2000 ("the Act"). Please note that whilst the Trust strives to be open and is normally able to satisfy requests in full, the right of access is not absolute and we may therefore have to refuse queries, either in full or in part, on the basis of the exemptions (for example, in cases where disclosure would breach patient confidentiality, or put people in danger). All such decisions will be made, and fully justified, in accordance with the law.

We are required under the Act to respond to valid queries no later than the twentieth working day following receipt. Your request was received on 16/08/2019, which means our deadline for response calculates to 13/09/2019. If we are able to respond to you sooner than this, we will do so.

Should you have any queries or concerns in the meantime, please contact us directly using the e-mail address below - quoting reference number 19-1522

Please note: if, having fully considered your request, we reasonably require further information in order to respond, we will request this from you by e-mail as soon as possible. In all such cases, the above timescales will be disregarded and the 20 working day clock shall instead begin once we have received the necessary clarification. There shall be no duty for us to comply with your request until we receive this information from you.

Kind Regards,

Lorna

Dear informationgovernance (LEEDS TEACHING HOSPITALS NHS TRUST),

Morning, thank you very much for the information provided.

The Department of Health and Social Care document “EU Exit Operational Readiness Guidance” dated 21 December 2018 states:

https://assets.publishing.service.gov.uk...

“Actions for providers
Local EU Exit readiness preparations
Risk assessment and business continuity planning:

· Undertake an assessment of risks associated with EU Exit by the end of January 2019, covering, but not limited to
o The seven key areas identified nationally and detailed below
o Potential increases in demand associated with wider impacts of a ‘no deal’ exit.
o Locally specific risks resulting from EU Exit.
· Continue business continuity planning in line with your legal requirements under the Health and Social Care Act 2012, taking into account this guidance and working with wider system partners to ensure plans across the health and care system are robust. These organisational and system-wide plans should be completed at the latest by the end of January 2019.
· Test existing business continuity and incident management plans against EU Exit risk assessment scenarios by the end of February to ensure these are fit for purpose.”

Please can I have the following:

(1) LTHTs business continuity planning in regards to Brexit, in line with your legal requirements under the Health and Social Care Act 2012, taking into account this guidance and working with wider system partners to ensure plans across the health and care system are robust
(2) Results of testing of existing business continuity and incident management plans against EU Exit risk assessment scenarios
(3) A list of any escalations regarding “any points of concern on specific issues to regional NHS EU Exit or departmental mailboxes listed in this guidance”, what the escalation related to and what the outcome of the escalation was.
(4) Record of revenue and capital costs incurred by the Trust as a result of complying with the guidance, see page 24 “Record costs (both revenue and capital) incurred in complying with this guidance. Costs with a direct financial impact should be recorded separately to opportunity costs.”
(5) Agenda, minutes and papers from the risk management committee meeting referenced in your response here: "I enclose a copy of the risk assessment for EU Exit which was presented to the Trust's Risk Management Committee in September 2019 as part of the Corporate Risk Register. The latest, signed off, summary of the impacts and mitigation was presented to the Trust board in March and is available online at https://www.leedsth.nhs.uk/assets/Board-... with a further update to the board at their meeting on 26th September."

Thanks

Yours sincerely,

Mike McAtominey
