Local Authority Support at Croydon council provided to migrants with No Recourse to Public Funds (NRPF) status

Dear Croydon Borough Council,

Please provide the following information under the Freedom of Information Act 2000.

1. How many requests for support from families where the parent(s) has No Recourse to Public Funds (NRPF) status have the council received in the last 6 months under Section 17 of the Children Act 1989?

2. How many requests for support from individuals with No Recourse to Public Funds (NRPF) status have the council received in the last 6 months under Section 18 of the Care Act 2014 (for adults with care needs)?

3. How many requests for support from individuals with No Recourse to Public Funds (NRPF) status have the council received in the last 6 months under Section 23 and 24 of the Care Act for a young person formerly looked after by the local authority?

4. How many requests for support under Section 17 of the Children Act 1989 from families where the parent(s) has No Recourse to Public Funds (NRPF) status have the council received in the last 6 months where the parent(s) immigration status excludes them from social services support under Schedule 3 of the Nationality Asylum and Immigration Act 2002?

5. How many requests for support under Section 18 or Section 23 and 24 of the Care Act 2014 from individuals with No Recourse to Public Funds (NRPF) status have the council received in the last 6 months where the individual is excluded under Schedule 3 of the Nationality Asylum and Immigration Act 2002?

6. How many Child in Need assessments were carried out by the council on families where the parent(s) has NRPF status in the last 6 months (full assessments not just initial screening)?

7. How many Human Rights assessments were conducted by the council where an individual, or parent(s) if it is a family case, has NRPF status and is excluded under Schedule 3 of the Nationality Asylum and Immigration Act 2002 in the 6 months?

8. When the council receives a referral for support for a family with NRPF status under Section 17 of the Children Act 1989, what is the statutory process to respond to these referrals, does the local authority Children’s Services use an initial screening to decide whether a full Child in Need assessment is required?

9. Does the council use social workers or caseworkers (or both) to conduct the assessments used to decide whether to provide support to individuals or families with NRPF status?

10. How many requests for support were granted by the council resulting in the individual or family with NRPF receiving support from the council in the last 6 months:
a. under Section 17 of the Children Act 1989?
b. under Section 18 of the Care Act 2014?
c. under Sections 23 and 24 of the Care Act 2014?

11. How many of the cases where individuals or families with NRPF status received support from the council in the last six months were individuals who were also excluded under Schedule 3 of the Nationality, Asylum and Immigration Act 2002?

12. For the requests for support under Section 17 of the Children Act 1989 for families where the parent(s) has NRPF status that were refused, how many of the cases were refused for each of the following reasons:
a. The immigration status of the family (parent(s)) precludes the local authority from providing support under Section 17 of the Children Act 1989.
b. That the family did not live in the borough and was therefore the responsibility of a different local authority.
c. That the family were deemed not to be destitute or the child(ren) were deemed not ‘in need’ and hence they did not require support.
d. The parents did not have leave to remain in the UK and could freely return to their country of origin (there was no legal or practical barrier to their return).
e. Other reason

Thank you for your recent request.

 

Your request is being considered and you will receive a response within
the statutory timescale of 20 working days, subject to the application of
any exemptions. Where consideration is being given to exemptions the 20
working day timescale may be extended to a period considered reasonable
depending on the nature and circumstances of your request. In such cases
you will be notified and, where possible, a revised time-scale will be
indicated. In all cases we shall attempt to deal with your request at the
earliest opportunity.

 

There may be a fee payable for the retrieval, collation and provision of
the information requested where the request exceeds the statutory limit or
where disbursements exceed £450. In such cases you will be informed in
writing and your request will be suspended until we receive payment from
you or your request is modified and/or reduced.

 

Your request may require either full or partial transfer to another public
authority. You will be informed if your request is transferred.

 

If we are unable to provide you with the information requested we will
notify you of this together with the reason(s) why and details of how you
may appeal (if appropriate).

 

Please note that the directorate team may contact you for further
information where we believe that the request is not significantly clear
for us to respond fully.
